How to Report a Customized Cosmetics Sales Business — Compounding Manager, Facility Standards, and the 30,000 won Report Fee

To mix or subdivide cosmetic contents for sale, you must report a customized cosmetics sales business to the head of the regional office of food and drug safety with jurisdiction over the store location (Cosmetics Act, Article 3-2; Enforcement Rule of the Cosmetics Act, Article 8-2). You must separate or partition the mixing and subdividing space from other spaces (Enforcement Rule, Article 8-4) and employ a customized cosmetics compounding manager who has passed the qualification examination (Cosmetics Act, Article 3-4). The report fee is 27,000 won for electronic filing and 30,000 won for in-person or postal filing (Enforcement Rule, Annexed Table 9).

Procedure

Procedure type
  • Notification Difficulty Low

You submit the statutory report form and required documents. Once the documents are in order the report is accepted; for some reports the authority checks the contents before accepting it.

  1. 1. Confirm that the business must be reported

Customized cosmetics are cosmetics made by adding the contents of other cosmetics or raw materials designated by the Minister of Food and Drug Safety to the contents of manufactured or imported cosmetics, and cosmetics made by subdividing such contents (Cosmetics Act, Article 2, Subparagraph 3-2). Simple subdivision of cosmetics specified by Prime Minister's Decree, such as solid soap, is excluded. Because you may not arbitrarily mix or subdivide cosmetics already distributed and sold to consumers (same Act, Article 5, Paragraph 3), decide first where the contents and raw materials for mixing and subdividing will come from.

  2. 2. Secure a compounding manager and check grounds for disqualification

A customized cosmetics compounding manager must have passed the qualification examination administered by the Minister of Food and Drug Safety (Cosmetics Act, Article 3-4). If the business operator has passed the examination, the operator may personally perform the compounding manager's duties at one of its stores, and that store is deemed to have a compounding manager (Enforcement Rule, Article 8-2, Paragraph 4). A person under adult guardianship or a person serving a sentence of imprisonment without labor or heavier, or under a suspended sentence, for violating the Cosmetics Act, among others, may not file the report (Cosmetics Act, Article 3-3).

  3. 3. Prepare the mixing and subdividing space and the facility specification

The mixing and subdividing space must be separated or partitioned from spaces used for other purposes, with an exception only where it is recognized that no public health hazard is likely to arise (Enforcement Rule, Article 8-4). Based on the store floor plan and photographs, set out the location of the mixing and subdividing space, the partition method, and the equipment and tools to be used in the facility specification.

  4. 4. Submit the report and receive the report certificate

Attach a copy of the compounding manager's certificate and the facility specification to the customized cosmetics sales business report (Form No. 6-3) and submit it to the head of the regional office of food and drug safety with jurisdiction over the store; the corporate register certificate is checked by the office through shared administrative information (Enforcement Rule, Article 8-2, Paragraphs 1 and 2). If the requirements are met, the business is entered in the report ledger and a report certificate (Form No. 6-4) is issued (same Article, Paragraph 3). To operate temporarily for up to 1 month outside the reported location, file a separate report with a copy of the report certificate and a copy of the compounding manager's certificate attached.

  5. 5. Post-report obligations and change reports

You must check the quality test reports of contents and raw materials before mixing or subdividing, prepare and keep sales records (batch number, expiry date or period after opening, sales date and quantity), explain to consumers, and report adverse reaction cases (Enforcement Rule, Article 12-2). When you change the business operator, the store's trade name or location, or the compounding manager, file a change report (Form No. 6-5) with the report certificate and documents proving the change attached, and if the location moves, file it with the regional office with jurisdiction over the new location (Enforcement Rule, Article 8-3).

Checked against the statutes on

Statutes and public notices change, so each case needs to be checked individually. Statute titles are given in English for reference. The Korean statutes are the authoritative text.

Check these first

  • Arbitrarily mixing or subdividing cosmetics already distributed and sold to consumers is prohibited (Cosmetics Act, Article 5, Paragraph 3), and the quality test reports of contents and raw materials must be checked before mixing or subdividing (Enforcement Rule, Article 12-2), so decide the supply structure for contents and how you will obtain quality test reports before filing the report.
  • A customized cosmetics compounding manager must receive initial training within 6 months from the date of starting work and refresher training every year thereafter (Enforcement Rule, Article 14, Paragraph 1), and the operator must report the previous year's list of raw materials by the end of February each year (Enforcement Rule, Article 13, Paragraph 4). Violations are subject to an administrative fine of up to 1,000,000 won (Cosmetics Act, Article 40, Paragraph 1).

Frequently asked questions

Where do I report a customized cosmetics sales business?
You report it to the head of the regional office of food and drug safety with jurisdiction over the store location. The report must be submitted with a copy of the compounding manager's certificate and the facility specification attached (Enforcement Rule of the Cosmetics Act, Article 8-2, Paragraph 1). When you move and file a change report, you submit it to the regional office with jurisdiction over the new location (same Enforcement Rule, Article 8-3, Paragraph 2).
If the owner holds the compounding manager qualification, do I still need to hire a separate employee?
If there is only one store, the owner may take on the compounding manager's duties. An operator who has passed the qualification examination may perform the compounding manager's duties at one of its stores, and that store is deemed to have a compounding manager (Enforcement Rule of the Cosmetics Act, Article 8-2, Paragraph 4). If there are several stores, each remaining store must have its own compounding manager.
How much is the customized cosmetics sales business report fee?
It is 27,000 won for electronic filing and 30,000 won for in-person or postal filing. A change report for a change of compounding manager is free, and other change reports cost 9,000 won for electronic filing and 10,000 won for in-person or postal filing (Enforcement Rule of the Cosmetics Act, Annexed Table 9).
What should I do if the customized cosmetics compounding manager resigns?
You must appoint a new compounding manager and file a change report. A change of compounding manager is a ground for a change report (Enforcement Rule of the Cosmetics Act, Article 8-3, Paragraph 1, Subparagraph 3), and the Act requires a report when reported matters are changed (Cosmetics Act, Article 3-2, Paragraph 1). The Enforcement Rule sets no deadline in days, so it is safest to report as soon as the change occurs, and the departing compounding manager may submit a report of non-engagement in management duties (Form No. 6-2) (same Enforcement Rule, Article 8-2, Paragraph 5).
Do I need to report a customized cosmetics sales business if I only subdivide shampoo or lotion for sale?
Subdividing cosmetic contents for sale is, in principle, subject to the report. Cosmetics made by subdividing the contents of manufactured or imported cosmetics are customized cosmetics, and only simple subdivision of cosmetics specified by Prime Minister's Decree, such as solid soap, is excluded (Cosmetics Act, Article 2, Subparagraph 3-2 (b)). An amended provision taking effect on April 28, 2027 will allow a business that sells only subdivided cosmetics specified by Prime Minister's Decree to employ an employee who has completed subdivision training instead of a compounding manager (same Act, Article 3-2, Paragraph 2, proviso), so you should check the standards before and after it takes effect.
Am I punished if I sell without reporting a customized cosmetics sales business?
Operating a customized cosmetics sales business without a report may be punished by imprisonment of up to 3 years or a fine of up to 30,000,000 won (Cosmetics Act, Article 36, Paragraph 1, Subparagraph 1-3). Even after reporting, failing to report the list of raw materials used in customized cosmetics by the end of February each year or a compounding manager failing to receive training is subject to an administrative fine of up to 1,000,000 won (same Act, Article 40, Paragraph 1; Enforcement Rule, Article 13, Paragraph 4).
Can an administrative agent handle the customized cosmetics sales business report?
Yes, you can entrust the preparation of the report and its submission to the regional office of food and drug safety. Hwang Yunsang Administrative Office checks the compounding manager's qualification and grounds for disqualification, prepares the facility specification based on the store floor plan and photographs, submits the report, responds to requests for supplementation, and prepares later change report documents. Whether the report is accepted is decided by the regional office of food and drug safety.
