Livestock Product Distribution Seller Business Report — Selling OEM Packaged Meat Under Your Own Brand and Keeping Transaction Records for 1 Year and Complaint Records for 2 Years
To have packaged meat, processed meat products, processed milk products or processed egg products processed or packaged by a livestock product processing business or meat packing business operator and distribute and sell them under your own brand, you must report a livestock product distribution seller business, a type of livestock product sales business, to the head of the Si/Gun/Gu having jurisdiction over the business office (Livestock Products Sanitary Control Act, Articles 21 and 24; Enforcement Decree of the same Act, Article 21, Subparagraph 7(e)). The reporting authority must give notice of acceptance within 3 days of receiving the report, and after starting business you must keep meat and packaged meat purchase transaction records for 1 year and consumer complaint records for 2 years (Enforcement Rule of the same Act, Annex 13).
Procedure
- Notification Difficulty Low
You submit the statutory report form and required documents. Once the documents are in order the report is accepted; for some reports the authority checks the contents before accepting it.
1. Confirm the type of business
A livestock product distribution seller business has packaged meat, processed meat products, processed milk products or processed egg products processed or packaged by a livestock product processing business or meat packing business operator and distributes and sells the processed or packaged products under its own brand (Enforcement Decree of the Livestock Products Sanitary Control Act, Article 21, Subparagraph 7(e)). Cutting and packaging meat yourself to make packaged meat requires a meat packing business permit, and re-dividing meat or packaged meat for sale requires a meat sales business report, so first check this together with the permitted business type of the contractor (same Article, Subparagraphs 4 and 7(a)).
2. Prepare the business office, storage warehouse and returns storage
You must have an independent business office for business activities, though another business office may be shared if it does not interfere with business, and the warehouse for hygienic storage of livestock products may be installed or leased at a location different from the business office (Enforcement Rule of the same Act, Annex 10, Subparagraph 8(b)4)). If a dedicated warehouse cannot be provided, part of the contractor's storage warehouse may be used separately under a use contract, and a permanently operated storage facility for returned and exchanged products must be provided.
3. Hygiene training and health examination
A person intending to operate the business must complete 6 hours of livestock product hygiene training before starting business and may not operate without it (Livestock Products Sanitary Control Act, Article 30(2) and (5); Enforcement Rule of the same Act, Article 49(2)1). Persons who only store and sell fully packaged livestock products are excluded from health examinations, but if any worker handles livestock products directly, that worker must have a health examination before starting work (Enforcement Rule of the same Act, Article 44).
4. Submit the business report
Submit the business report to the reporting authority with the facility details and layout of the business premises and, if leased, a copy of the facility use contract; the building register, land use plan confirmation and corporate registration certificate are checked by the reporting authority through shared administrative information (Enforcement Rule of the same Act, Article 35(1) and (2)). The reporting authority gives notice of acceptance within 3 days and issues a report certificate (Livestock Products Sanitary Control Act, Article 24(4); Enforcement Rule of the same Act, Article 35(6)).
5. Record keeping and change reports after starting business
When you purchase meat or packaged meat, record the type, quantity, origin, traceability number and supplier in the transaction record and keep it for 1 year from the purchase date, and when a consumer reports a complaint such as a foreign substance, keep the details for 2 years and the evidence for 6 months (Enforcement Rule of the same Act, Annex 13, Subparagraph 3(j) and (r)). If the trade name, location or business facilities change, file a change report within 7 days of the change (Enforcement Rule of the same Act, Article 36).
