This is the Saturday briefing. Among the legislative notices posted on the National Participation Legislation Center yesterday (October 23), I have selected three cases that directly affect those contesting administrative dispositions, those managing facilities, and business operators receiving subsidies.
Today’s Key Highlights in 3 Lines
- Amendment to the Enforcement Rule of the Administrative Appeal Act: Use date of birth instead of resident registration number on the petition, separate entry for the place of service, and comments due by December 2 (Wed).
- Amendment to the Enforcement Decree of the Safety Control of Children’s Play Facilities Act: Expansion of applicable locations, safety assessments at least once a month, notification of serious accidents within 3 days, and comments due by December 8 (Tue).
- Amendment to the Enforcement Decree of the Public Finance Recovery Act: Establishment of installment payments for recovery amounts and administrative fines, and comments due by November 12 (Thu).
1. Administrative Appeal Petitions: Use Date of Birth Instead of Resident Registration Number

- What is changing: The Anti-Corruption and Civil Rights Commission (ACRC) has issued a legislative notice for a partial amendment to the Enforcement Rule of the Administrative Appeal Act (ACRC Notice No. 2026-110). The forms will be revised so that if the person filing an administrative appeal or a related application is an individual, they enter their date of birth instead of their resident registration number or alien registration number, and if it is a corporation, they enter the corporate registration number. Additionally, a separate section for the “place of service” (place of delivery) will be added so that documents can be received at a location other than one’s registered address without needing to file a separate application for a change of address.
- Who it affects: Petitioners of administrative appeals (individuals, corporations, foreigners) and those filing related applications such as a suspension of execution (stay).
- Effective date: Comment period: October 23 (Fri) – December 2 (Wed); Effective date: ⚠️ Original text to be confirmed.
- An Administrative Agent’s Note: As this is still in the notice stage, current petitions should still use the existing forms. However, for those who need to receive documents at a location other than their registered address—such as a workplace or temporary residence—utilizing the “place of service” section after the amendment will reduce the risk of missing a written response or a decision on the appeal. Since the deadline for filing an appeal remains 90 days from the date of becoming aware of the disposition, please ensure you check the deadline first.

2. Enforcement Decree of the Safety Control of Children’s Play Facilities Act: Expansion of Applicable Locations and Monthly Safety Assessments

- What is changing: The Ministry of the Interior and Safety (MOIS) has issued a legislative notice for a partial amendment to the Enforcement Decree of the Safety Control of Children’s Play Facilities Act (MOIS Notice No. 2026-1301). Due to the legislative amendment, places that provide play activities to children even without play equipment will be included as “children’s play facilities,” thereby expanding the applicable locations under Attachment 2 of the Enforcement Decree. Safety assessments conducted by the management entity shall be performed at least once a month, and detailed standards and methods will be announced by the Minister of the Interior and Safety (Draft Article 11-4). If a serious accident occurs, it must be reported to the head of the supervisory authority within 3 days of becoming aware of it (Draft Article 14, Paragraph 2), and acts that threaten the safety of children using exercise equipment will be added to the restrictions on activities within the facility (Draft Article 11-3, Subparagraph 7).
- Who it affects: Management entities of children’s play facilities (apartment management offices, operators of kids’ cafes/indoor play spaces, etc.) and supervisory authorities.
- Effective date: Comment period: October 23 (Fri) – December 8 (Tue); Effective date: ⚠️ Original text to be confirmed.
- An Administrative Agent’s Note: Businesses operating play spaces without play equipment must check the proposed amendment to Attachment 2 to see if they are newly subject to these regulations. To prevent omissions of mandatory duties once the amendment takes effect, it is advisable to include the monthly assessment records and the 3-day notification procedure for serious accidents in your internal checklists in advance.

3. New Provision for Installment Payments of Public Finance Fraudulent Claims Recovery Amounts and Administrative Fines

- What is changing: The Anti-Corruption and Civil Rights Commission (ACRC) has issued a legislative notice for a partial amendment to the Enforcement Decree of the Act on the Prohibition of False Claims for Public Finance and the Recovery of Unjustified Profits (Public Finance Recovery Act) (ACRC Notice No. 2026-109). New provisions for installment payments will be established so that if an individual or business is imposed with recovery amounts or administrative fines due to the fraudulent receipt of subsidies, etc., they may pay in installments if they face economic difficulties in paying the full amount at once (Proposed Article 8-2). The Enforcement Decree will determine the grounds for installment payments, application methods, the maximum number of installments, and the payment intervals.
- Who it affects: Individuals or businesses who have received public finance such as subsidies, grants, or contributions and have been subject to recovery or administrative fine dispositions.
- Effective date: Comment period: October 23 (Fri) – November 12 (Thu); the maximum number of installments, payment intervals and effective date: ⚠️ Original text to be confirmed.
- An Administrative Agent’s Note: Installment payment is a system for determining the method of payment, not a procedure to contest the disposition itself. If you have an objection to a recovery disposition, please check the deadline for filing an objection or an administrative appeal after receiving the disposition notice, and prepare separate documentation regarding your financial hardship, such as income and sales records.
