LAW & POLICY
The revised Private Education Act, taking effect on October 1st, requires individual tutors and cram schools teaching young children to register with the relevant education office. The implementing decree, passed by the National Council on September 22nd, broadly prohibits examinations and evaluations for recruitment and class division purposes, and imposes fines ranging from 1 million to 3 million won for each violation.
The 「Special Measures Act on the Management of Specific Buildings」, promulgated on June 16, 2026, will be enforced for 18 months starting December 17. It applies to certain residential buildings below a specific size that were substantially completed as of December 31, 2023, and requires reporting with attached design documents and field investigation reports. Information regarding eligibility requirements, usage approval criteria, fine structure, and the Incheon Building Ordinance’s enforcement fine standards are also included.
When a foreigner acquires domestic real estate, reporting must be completed within 30 days for sales, 60 days for gifts and other contracts, and 6 months for inheritance, auctions, and new construction. Seoul, all of Incheon’s 9 autonomous districts (including Yeongsu-gu (Songdo)), and 23 cities and counties in Gyeonggi Province require foreign land transaction permits before purchasing a house in designated areas, with the requirement in effect until August 25, 2027. We cover reporting deadlines, required documents, and foreign exchange bank reporting for non-residents.
After obtaining development permission and changing the land's topography, the process continues with final inspection, land division/zoning change application, and submission of a development burden calculation statement. We will guide you through the period and area requirements as stipulated in the laws and Incheon City Urban Planning Ordinance.
We provide information on when foreign exchange transaction reporting is required and not required when family members residing abroad receive gifts or inherit domestic real estate, stocks, or deposits, where to report, and the documents needed for overseas remittance, based on the Foreign Exchange Transaction Act and Foreign Exchange Transaction Regulations.
