Administrative Consultation and Advice

Administrative consultation and advice is the response to consultation or advice on administrative laws and administration under Article 2(1)6 of the Administrative Agents Act, organizing the preparation before applying for a permit or filing a report and the order of response after receiving a prior notice of disposition or a rejection, with a focus on procedures, documents and deadlines. For statutory civil petitions, administrative agencies set and publish processing periods by type (Article 17 of the Civil Petitions Treatment Act), and for statutory petitions that involve large costs, a preliminary review can be requested before the formal application (Article 30 of the same Act). Before a disposition that imposes obligations or restricts rights, an opinion may be submitted within the deadline stated in the prior notice (Articles 21 and 27 of the Administrative Procedures Act), and after the disposition the next steps are an objection within 30 days of receiving the disposition (Article 36 of the Framework Act on Administrative Procedures), an objection within 60 days for a rejection of a statutory civil petition (Article 35 of the Civil Petitions Treatment Act), or an administrative appeal within 90 days of learning of the disposition (Article 27 of the Administrative Appeals Act). Based on the notices received and existing documents, the administrative office confirms the current stage and which documents must be submitted to which agency and by when.

  • Advisory Difficulty Low

Work completed by our office’s review, guidance or submission — such as administrative consultation, pre-review of licensing, or submitting already prepared documents — without a separate review by the authority.

  1. 01

Identify the current stage: Using the documents received and the receipt number, confirm whether the matter is at pre-application preparation, under processing, a request for supplementation, a prior notice of disposition or a notice of disposition, and identify the disposing agency, the department in charge and the legal basis.

  2. 02

Calculate deadlines: Calculate as calendar dates, from the day the notice was received, the opinion submission deadline in the prior notice, the objection deadline (30 days from receipt of the disposition, 60 days for a rejection of a statutory civil petition) and the administrative appeal deadline (90 days from learning of the disposition, 180 days from the disposition), and mark the deadline that ends first.

  3. 03

Check the processing period and progress: Confirm the published processing period for the petition, and check for delay by counting in hours from the time of receipt if the period is 5 days or less, or in days if it is 6 days or more, excluding public holidays and Saturdays.

  4. 04

Review response routes: For statutory petitions involving large costs, consider requesting a preliminary review before the formal application; if a prior notice of an adverse disposition has been received, confirm that an opinion may be submitted in writing, orally or online with supporting evidence, and that failing to submit by the deadline is treated as having no opinion.

  5. 05

Organize documents and preparation order: Make a list of the application, opinion statement, objection or administrative appeal petition suited to the chosen route and the attachments, and explain in order which agency issues any missing materials and how to obtain them.

  6. 06

Summarize the consultation and follow-up work: Summarize in writing the confirmed stage, deadlines, submission office and required documents, and if document preparation or submission on the client's behalf is needed, proceed with that service.
