An agricultural company corporation is a company based on Article 19 of the Act on Fostering and Supporting Agricultural and Fisheries Business Entities; at least 1 farmer must participate as an investor, and its business purpose must relate to agriculture, such as farm management and the distribution, processing and sale of agricultural products. Investment by non-farmers is limited to within 90% if total investment is 8,000,000,000 won or less, and to total investment minus 800,000,000 won if it exceeds 8,000,000,000 won. Procedure type
  • Notification Difficulty Low

You submit the statutory report form and required documents. Once the documents are in order the report is accepted; for some reports the authority checks the contents before accepting it.

  1. 01

Check the farmer requirement for investors: A farmer who manages 1,000㎡ or more of farmland, sells 1,200,000 won or more of agricultural products a year, or engages in farming 90 days or more a year must participate as an investor. This is proven with a farmer confirmation or an agricultural business entity registration certificate.

  2. 02

Design investment ratios and business purposes: Divide shares so the non-farmer investment limit is observed, and set business purposes within a scope recognized as agricultural, such as farm management, distribution, processing and sale of agricultural products, and agricultural work services.

  3. 03

Prepare articles of incorporation and minutes: Draft the articles of incorporation, shareholder register and minutes of the promoters and board of directors so that farmer investment and business purpose requirements are shown. There is no legal minimum capital, but set the size according to support program plans.

  4. 04

Establishment report and registration: File an agricultural company corporation establishment report with the city, county or district of the main office, register the establishment within 14 days from receiving the report certificate, and then register the business.

  5. 05

Agricultural business entity registration and change management: Registration as an agricultural business entity with the National Agricultural Products Quality Management Service is needed for policy funds, support programs and tax reductions. If important matters such as the name, purpose or investment amount change, file a change report and recheck the farmer requirement whenever shares change.

If non-farmer investment exceeds the limit when investors change or capital increases, the agricultural company corporation requirement is broken, so check the ratio before changing shares.
