Outdoor Business (Terrace) Report

To put tables on the terrace in front of a cafe or restaurant and serve customers there, you must file a change report on matters of the business report for outdoor business under the Food Sanitation Act, within 7 days of the change, with the city, county or district office where the business is located. First check whether the outdoor space is directly connected to the indoor business area, whether you have the right to use the land, and whether it is space that must be kept clear under the Building Act, Road Act or Parking Lot Act. The report cannot be made if the space is a public open space, an open space within the site, mandatory landscaping, an evacuation route, a road or a mandatory parking space; on the second floor or above a railing of at least 1.2m is required, and fixed structures and open flames are not allowed. If the combined indoor and outdoor floor area is 100㎡ or more, disaster liability insurance is mandatory, and some local governments set their own outdoor business criteria.

You submit the statutory report form and required documents. Once the documents are in order the report is accepted; for some reports the authority checks the contents before accepting it.

  1. 01

Check the connection to the indoor business area: The outdoor business area must be directly connected to the business area inside the building. On a different floor it must be directly accessible up or down, and a separate space reached by going around the outside of the building is unlikely to be accepted.

  2. 02

Check the right to use: For a detached building, prove the right to use through ownership or a lease. In a multi-unit building an exclusive use right under the management rules is required and common areas cannot be used, so also check that the lease states the terrace use scope.

  3. 03

Review conflicts with laws in advance: The report cannot be made if the space is a public open space, an open space within the site, mandatory landscaping, an evacuation route, a road or a mandatory parking space. Compare the building register and layout with the site to filter out prohibited items first, and also check the local government's outdoor business criteria.

  4. 04

Meet the facility standards: On the second floor or above, a railing of at least 1.2m is required. Fixed structures are not allowed, only movable furniture, and open flames cannot be installed, so match your installation plan to these standards.

  5. 05

Check disaster liability insurance: Rest-area and general restaurants are required to carry disaster liability insurance if the combined indoor and outdoor floor area is 100㎡ or more. Calculate the total area and decide on coverage before reporting.

  6. 06

File the change report with the hygiene department: Prepare the change report with the existing business report certificate, a plan of the outdoor area and use right documents and file within 7 days of the change. If supplementation is requested, respond with drawings and site photos.

If a structure such as a fixed deck or roof is built first, the report may be refused for conflicting with an open space or evacuation route and the structure may have to be removed, so check conflicts before construction.
