Car Rental Business (Rent-a-Car) Registration

To rent out vehicles for a fee, you must register a car rental business with a business plan under Article 28 of the Passenger Transport Service Act. The registering authority is the Mayor/Do Governor, and where the authority has been delegated by ordinance, the transport department of the city, county or district where the main office is located accepts the application. The registration standards in Annex 6 of the Enforcement Rule cover three items: number of vehicles, garage and office. A nationwide business needs at least 50 vehicles; if the main office, branches and reservation offices are all in one city or county and the business operates only there, the number set by local ordinance (fewer than 50) applies, and the Ministry of Government Legislation has interpreted that the 50-vehicle standard applies where no ordinance exists. Rentable vehicles are limited to passenger cars, light and small vans, medium vans with 15 seats or fewer, and light or small special vehicles used as camping cars. Registration is refused if the applicant or a corporate officer falls under the disqualification grounds in Article 6 of the Act (for example, less than 2 years since completing a prison sentence for violating the Act, or less than 2 years since a registration was revoked).

The authority checks whether the statutory registration requirements, such as facilities, staff and capital, are met before issuing a registration certificate. Registration can be refused if the requirements are not met.

  1. 01

Decide operating area and fleet size: a nationwide business needs 50 or more vehicles; a business operating only within one city or county follows the number set by that local ordinance. First confirm with the transport department whether an ordinance exists and what number it sets.

  2. 02

Check disqualifications and vehicle types: confirm that the representative and corporate officers do not fall under Article 6 of the Passenger Transport Service Act, and that the vehicles to be secured are passenger cars, light or small vans, medium vans with 15 seats or fewer, or camping-type special vehicles.

  3. 03

Secure a garage and calculate its area: the garage area is calculated per vehicle as length × width or by the number of parking units. The garage should in principle be owned; land owned by others counts as owned only under a lease of 2 years or more, and part of a parking lot only under a use contract of 1 year or more.

  4. 04

Prepare the office and business plan: set up an office with the equipment and communication facilities needed to manage revenue and dispatch, and prepare a business plan stating the locations of the main office and branches, number of vehicles by type, garage location, area and capacity, and operating area.

  5. 05

Submit the registration application: file the application (Form No. 33) with the business plan, a vehicle list or vehicle purchase contract, and documents proving ownership or right of use of the garage land. Once the authority confirms the standards are met, it issues a car rental business registration certificate.

  6. 06

Register vehicles and report rental terms: if the fleet was recognized based on purchase contracts, complete vehicle registration within 30 days of the certificate's issuance and submit copies of the registration certificates. Report the rental terms and conditions to the Mayor/Do Governor before starting business.

Because the garage must in principle be owned, leasing someone else's land for less than 2 years does not meet the standard, so check the lease term, land category and vehicle access before signing. After registration, when a lease for a rented facility expires and is renewed, an application for change of registration must be filed 1 month before expiry.
