Content-Certified Mail Drafting

Content-certified mail is a certification service under Article 25(1)(4) of the Enforcement Rule of the Postal Service Act, in which the post office certifies that a sender sent a document with specific content to a recipient on a specific date. It presupposes registered mail and is sent at a post office counter or through Internet Post Office. It does not prove that the content is true or that the recipient actually received it (receipt is confirmed separately by delivery certification), and it has no coercive force. However, since an expression of intent directed at another party takes effect when it reaches that party (Civil Act Article 111), it serves as evidence of the content and timing of a termination or demand notice. A demand made to delay a statute of limitations loses its interruption effect unless a judicial claim, seizure or provisional seizure, etc. follows within 6 months (Civil Act Article 174). Documents contrary to public order or morals, and documents whose original and copy cannot easily be recognized as identical, are not accepted. Hwang Yoon-sang Administrative Office drafts the content-certified mail text in the client's name and handles sending it through the post office.

  • Drafting Difficulty Low

Work completed by drafting documents such as contracts, certified letters or statements of fact, without review by a government authority.

  1. 01

Confirm purpose and counterparty: Decide whether the purpose is a payment demand, a contract termination notice, a demand to preserve a claim near its limitation period, or a request for performance, and confirm the parties and legal relationship from contracts and transaction records. The wording and attachments depend on the purpose.

  2. 02

Specify facts and demands: State dates, amounts, contract clauses and accounts in figures, and write the demand concretely with a deadline and method, such as payment of a set amount by a set date. Leave out emotional language and unsupported assertions.

  3. 03

Draft and review the text: In the client's name, write the sender and recipient names and addresses, a title, the facts, the demand, and a notice of the action to be taken if the deadline passes. For a termination notice, check that the termination ground and method of notice match the contract; for a demand, check that the 6-month period after arrival can be calculated.

  4. 04

Prepare the original and 2 copies: Under Article 48 of the Enforcement Rule, prepare the original and 2 copies on A4 paper (210 mm by 297 mm); the copies must be photocopies of the original. Mark any corrections with the correction wording and character count and add the sender's seal or signature. The sender and recipient names and addresses on the envelope and documents must match (Articles 50 and 51).

  5. 05

Submit at the post office: Submit at a post office counter or through Internet Post Office. At the counter, the staff compare the original and copies, write the date and post office name, apply seals across the pages, and the sender seals the original in the envelope in front of the staff (Article 52). After acceptance, names, addresses and wording cannot be changed (Article 50(3)). If the arrival date needs to be confirmed, request delivery certification as well.

  6. 06

Retention and follow-up schedule: The post office keeps 1 copy for 3 years from the day after sending and returns the other to the sender (Article 48(3)). If lost, re-certification or inspection can be requested within 3 years from the day after sending (Articles 54 and 55). For a demand, mark on the calendar the date 6 months after the arrival date shown by the delivery certification.

The basic scope assumes one sender, one recipient, one demand, 10 pages of evidence and a newly drafted two-page letter. We deliver three identical copies or an electronic file and mailing instructions; the client mails it. Two pages are an estimate, not a drafting-time cap. Two ordinary revisions are included.
