Procedure
Procedure
- Permit Difficulty High
A procedure that allows a business, activity or stay that the law generally restricts, after review; licenses fall into this type. The authority reviews facility standards, location and consultation with other agencies, and a permit can be refused if the standards are not met.
- 01
Confirm the dispatch type: Separate a transfer from a foreign company's head office to its affiliate, branch or office in Korea from a transfer of staff at an overseas branch of a Korean listed company or public institution to the head office in Korea. The latter needs the head office's overseas direct investment report acceptance or overseas branch establishment report acceptance and proof of overseas remittance.
- 02
Check the employment condition: Confirm with a certificate of employment that the transferee has worked for 1 year or more at the head office or branch, and state in the personnel order (dispatch order) the essential duties the person will take on in Korea as an executive, manager or professional. Employees who only do simple clerical or manual work are not eligible for D-7.
- 03
Match the Korean establishment form and scope of work: A liaison office cannot conduct business, so only staff suited to market research, liaison and promotion can be sent there; a branch operates after the foreign exchange bank establishment report, registration and business registration. Prepare proof of the Korean branch or office and evidence of business fund inflow or a business plan.
- 04
Apply for the certificate for confirmation of visa issuance: The Korean branch or office acts as inviter and files the application form with the attachments at the immigration office with jurisdiction over its address or through HiKorea. Documents issued abroad must carry an apostille or consular legalization and be submitted with a translation.
- 05
Visa issuance and alien registration: Once the confirmation number is notified, the transferee files a visa application at a Korean embassy or consulate and enters Korea, then registers at the immigration office with jurisdiction over the place of stay within 90 days of entry. The spouse and unmarried minor children can stay together under F-3 (Dependent Family) status.
- 06
Extension of the period of stay: Before the period of stay ends, submit the integrated application form with the personnel order (dispatch order), documents on the report (permit) for the Korean branch, proof of business fund inflow such as foreign exchange purchase certificates, and a tax payment certificate. Staff of an overseas branch dispatched to the Korean head office submit a certificate of employment and a tax payment certificate.

Basic documents
Basic documents
If the Korean establishment form and the actual work do not match, for example a liaison office invites someone and gives them sales duties, the certificate for confirmation of visa issuance may be refused, so align the scope of work in the dispatch order and invitation letter with the establishment form before applying.
