Disabled-Owned Business Confirmation Certificate Issuance

A disabled-owned business confirmation certificate is the document a company obtains under Article 18-2 of the Act on the Promotion of Disabled Persons' Business Activities to confirm that it is a disabled-owned business, in order to receive support such as priority purchasing by public institutions (Article 9-2 of the same Act); the application is filed through the SMPP public procurement portal for SME products, and the Disabled Business Support Center handles intake and review of the application. Under Article 2 of the Enforcement Decree, a sole proprietorship qualifies if a disabled person holds the business registration, a company qualifies if a disabled person is registered as an officer with power of representation (with co-representatives, the disabled co-representative must hold more voting shares than the non-disabled co-representative), and a cooperative qualifies if disabled members make up a majority of both members and paid-in shares and the chairperson is a disabled member. A medium-sized enterprise must have disabled persons make up 30% or more of its regular workers, while this ratio does not apply to small enterprises; here, a disabled person means a holder of a disability registration card or a person rated with a disability grade as a person of national merit. The processing period is 7 days, there is no fee, and the certificate is valid for 3 years from issuance (or until the re-assessment date of the disability or disability grade if that falls within 3 years).

The authority reviews documents, and where needed carries out an on-site inspection, to confirm that statutory criteria such as company size, ownership or research staff are met before issuing a confirmation or recognition certificate.

  1. 01

Checking the disabled representative and business type: Confirm that the representative holds a disability registration card or has a disability grade as a person of national merit. For a sole proprietorship, check the business registration in the disabled person's name; for a company, the registration as an officer with power of representation and the voting shares between co-representatives; for a cooperative, the majority of disabled members and paid-in shares and the chairperson's status.

  2. 02

Small or medium enterprise and employment ratio: First determine whether the business is a small enterprise under the Framework Act on Small and Medium Enterprises by industry sales thresholds. For a medium-sized enterprise, calculate whether disabled persons make up 30% or more of all regular workers using the withholding tax return and the roster of disabled employees, and reset the application timing if the ratio falls short.

  3. 03

Drafting the application and attachments: Prepare the Disabled-Owned Business Confirmation and Change Confirmation Application (Form No. 1 of the Enforcement Decree), with the statement of changes in shareholdings for companies, the partnership agreement for joint proprietors, and the member and investor registers for cooperatives. The business registration certificate, VAT tax base certificate and disability certificate need not be submitted if the applicant consents to shared administrative information.

  4. 04

Filing through the SMPP portal and supplements: Register the company information on the portal and submit the application and attachments on the client's behalf. The processing period is 7 days, and if the Disabled Business Support Center requests related materials, supplementary documents are prepared on the same basis.

  5. 05

Responding to document and on-site reviews: The Center checks through document and on-site reviews whether the disabled representative actually runs the business. Signatures of the representative on contracts and approval documents, who controls the corporate bank account and financial authentication tools, and the employee roster are organized in advance to match actual operations, and explanatory materials are prepared for the review.

  6. 06

Management after issuance: Once confirmed, the confirmation certificate (Form No. 2) is printed from the portal. If confirmed details such as the representative or shareholdings change, a change confirmation is applied for with the same form, and re-confirmation is applied for to keep receiving support after the validity period ends.
