Environmental Emission Facility Permits

Under Article 23 of the Clean Air Conservation Act and Article 33 of the Water Environment Conservation Act, facilities that discharge air pollutants or water pollutants must obtain a permit or file a report before installation. For air, facilities generating specified hazardous air pollutants above the threshold or located in special countermeasure areas require a permit, and all other facilities require a report (Article 11 of the Enforcement Decree of the Clean Air Conservation Act); for wastewater, facilities discharging specified hazardous water pollutants and facilities within special countermeasure areas or within a set distance upstream of water source protection zones require a permit (Article 31 of the Enforcement Decree of the Water Environment Conservation Act). Filings are handled by the competent city/province (or, by delegation, the city/county/district) or the regional environmental office, and once installation is complete, an operation start report must be filed before operation begins. Significant changes, such as increasing the permitted facility capacity or wastewater discharge volume by 50/100 or more, require a modification permit, and other changes require a modification report.

Procedure

Procedure

Procedure type
  • Permit Difficulty High

A procedure that allows a business, activity or stay that the law generally restricts, after review; licenses fall into this type. The authority reviews facility standards, location and consultation with other agencies, and a permit can be refused if the standards are not met.

  • Notification Difficulty Low

You submit the statutory report form and required documents. Once the documents are in order the report is accepted; for some reports the authority checks the contents before accepting it.

  1. 01

Check whether the equipment is an emission facility: list equipment that emits pollutants, such as painting, drying, crushing or melting equipment, boilers, and washing or plating processes, together with equipment specifications, and compare them against the emission facility classifications and capacity thresholds in the Enforcement Rules of the Clean Air Conservation Act and the Water Environment Conservation Act.

  2. 02

Distinguish permit from report: determine whether a permit or a report is required by checking whether specified hazardous air or water pollutants are generated and whether the site is in a special countermeasure area or upstream of a water source protection zone. Also review the report exceptions for cases where all wastewater is entrusted for treatment or sent to a public wastewater treatment facility.

  3. 03

Prepare statements and drawings: prepare the statement of raw material, fuel and water usage, product output and projected pollutant discharge, and the installation statements for emission and prevention facilities; for air, attach the general drawing of prevention facilities and the annual maintenance plan, and for wastewater, attach the location map and wastewater discharge process flow chart.

  4. 04

File the application and respond to supplementation requests: submit Form No. 2 of the Enforcement Rule of the Clean Air Conservation Act for air, or Form No. 12 of the Enforcement Rule of the Water Environment Conservation Act for wastewater, to the competent authority, revise the statements and drawings as requested, and begin installation after receiving the permit or report certificate.

  5. 05

File the operation start report: once the emission and prevention facilities are installed, file the report on Form No. 5 (air) or Form No. 16 (wastewater) with the permit or report certificate attached before operation begins. If the reported start date changes, file a change report for the start date.

  6. 06

Manage changes: when equipment is added or replaced, raw material or water usage changes, or processes change, first confirm whether the change requires a modification permit or a modification report, and file at the appropriate time so that the actual facility does not diverge from the permitted or reported details.
