Invitation of a Marriage Immigrant's Parents (F-1-5)

Visiting and joining family (F-1-5) is the type within visiting and joining family (F-1) in Annex 1-2 of the Enforcement Decree of the Immigration Act under which a marriage immigrant who is pregnant or raising a minor child invites parents or other family from the home country; the invitee applies for a visa at a Korean diplomatic mission abroad, or the inviter in Korea applies to the competent immigration office for a certificate of visa issuance confirmation. Under Ministry of Justice guidance, the invitation is possible until the end of September of the year the child turns 9 (the year the child turns 12 for single-parent families and families with 3 or more minor children), invitations are limited to 2 per child, and both parents of the marriage immigrant may be invited together. A person staying more than 90 days must complete alien registration within 90 days of entry under Article 31 of the Immigration Act, and the period of stay is extended one year at a time. Past unauthorized employment or overstay by the invitee can be grounds for refusal, so it is checked before applying.

Procedure

Procedure

Procedure type
  • Permit Difficulty High

A procedure that allows a business, activity or stay that the law generally restricts, after review; licenses fall into this type. The authority reviews facility standards, location and consultation with other agencies, and a permit can be refused if the standards are not met.

  1. 01

Confirm the inviter's eligibility: The inviter is in principle the Korean spouse of the marriage immigrant, and a marriage immigrant holding F-5-2 (permanent residence), or one who acquired nationality after staying under F-6 (marriage immigrant) or F-5-2, may invite in place of the spouse. A single-parent marriage immigrant raising a child alone after the marriage ended may also invite, so the current status is first checked with the family relationship certificate.

  2. 02

Show the childcare need and calculate the deadline: Show the need for care with a pregnancy confirmation or the child's birth documents, and calculate as dates the deadline of the end of September of the year the child turns 9 (the year the child turns 12 for single-parent and multi-child families) and the remaining number of invitations. If a school-age child has not been enrolled in school, the invitation is restricted.

  3. 03

Match the invitee's documents and names: Compare the name spelling on the home-country birth certificate and family documents with the parent's passport, and if they differ, prepare home-country confirmation documents linking them as the same person and a name comparison table. Home-country documents are submitted as authenticated originals with translations attached.

  4. 04

Check past stay history: If the invitee has stayed in Korea before, check the entry and exit records for overstay or unauthorized work, and prepare materials explaining that the stay was not for employment. If this is not resolved, the visa application may be returned or refused.

  5. 05

Apply for a certificate of visa issuance confirmation or a visa: The inviter in Korea submits the application for a certificate of visa issuance confirmation to the competent immigration office, or the invitee submits a visa application at the diplomatic mission. The certificate route allows supplement requests to be answered directly in Korea, and once the certificate is issued the visa is received at the mission abroad using its number.

  6. 06

Register and extend after entry: Complete alien registration at the immigration office with jurisdiction over the place of stay within 90 days of entry, and obtain an extension one year at a time before the period of stay ends. The stay in Korea runs within 3 or 4 years of entry until the end of March of the year the child turns 10 (for single-parent and multi-child families, within 3 years until the end of March of the year the child turns 13), and employment is not permitted during the stay.

If the invitee works for pay during the stay, the invitee faces departure measures and the inviter may also be barred from inviting for a certain period, so the whole family should know before entry that employment is not permitted.
