Preparation of Factual Statements and Fact-Certification Documents

Organizing facts is the preparation of 'documents certifying that a certain fact exists' under Article 2(1)2 of the Certified Administrative Agents Act and Article 2(2)(b) of its Enforcement Decree. Contracts, receipts, photos, communication records and public registers held by the client are aligned by date, place and person and organized into a statement of facts, account of events or status report. These documents are most often submitted to administrative agencies: supporting materials for opinion submissions, objections or administrative appeals against a disposition, statements of residence and stay history for immigration status reviews, and confirmation of business premises before a permit application. Fact investigation under Article 2(1)7 of the Act is limited to work entrusted under statutes, so general requests proceed as preparation of fact-certifying documents based on document review and on-site checks made with consent. What is checked are physical materials such as the condition of premises, facilities and land, documents and public registers.

Procedure type
  • Drafting Difficulty Low

Work completed by drafting documents such as contracts, certified letters or statements of fact, without review by a government authority.

  1. 01

Define the purpose and the facts to prove: decide the agency and procedure (opinion submission, objection, administrative appeal, immigration review, etc.) first, then list the facts and reference dates that must be proven in that procedure.

  2. 02

Collect materials and check originals: obtain original contracts, receipts, photos, videos and message records, confirm creation dates, shooting dates and sender numbers, and cross-check them against public registers such as building ledgers, land ledgers and registry certificates.

  3. 03

On-site check (where needed): if the current condition of premises, facilities or land is at issue, visit with the consent of the owner or occupant and record photos showing location and date together with measurements.

  4. 04

Chronological account: put the confirmed facts in a dated table and attach the supporting document number to each fact. Claims not backed by materials are recorded separately as the client's statement.

  5. 05

Draft the statement or status report: follow the recipient's form if there is one; otherwise write it in the order of purpose, scope, method, findings and list of attachments, and the administrative agent signs and seals it.

  6. 06

Submission and follow-up: with a power of attorney, submit it to the agency on the client's behalf, and if a supplement request or further question arrives, file a supplementary document with additional evidence.
