Factory Establishment Approval · Modification · Registration

To newly build or expand a factory with a factory building area of 500 square meters or more, or to change its industry type, approval for factory establishment must be obtained from the mayor, county head or district head under Article 13 of the Industrial Cluster Development and Factory Establishment Act, and changes to approved matters also require modification approval (or a report for minor matters). After approval, filing a completion report within 2 months from the date the final building use approval is obtained and installation of machinery and equipment is completed results in registration in the factory registry (Articles 15 and 16, Article 20 of the Enforcement Decree of the same Act), and factories under 500 square meters may apply for factory registration when they wish. Companies in industrial complexes are deemed approved when they sign an occupancy contract with the management agency, and they also file the completion report with the management agency. If registered matters such as the company name, industry type or factory site area change, a change of registration must be applied for within 2 months.

Procedure

Procedure

Procedure type
  • Approval Difficulty High

A procedure, such as establishing a corporation, a business plan or a transfer, that takes effect only when the authority reviews and approves it. The authority has wide discretion, so a well-prepared business plan and supporting evidence are important.

  • Registration Difficulty Medium

The authority checks whether the statutory registration requirements, such as facilities, staff and capital, are met before issuing a registration certificate. Registration can be refused if the requirements are not met.

  1. 01

Check the site and building: before signing a lease or purchase contract, check the zoning in the land use plan confirmation, the main use in the building register and whether the site is in an industrial complex, to confirm that a factory of the planned industry type can be located there.

  2. 02

Determine the procedure: based on the 500 square meter factory building area threshold and whether it is a new build, expansion or change of industry type, determine whether approval is required, whether factory registration can be applied for directly, or whether it is handled through an industrial complex occupancy contract. If only machinery is installed in an existing factory building, also check whether manufacturing facility installation approval applies.

  3. 03

Apply for approval: attach the business plan (Form No. 2-2) and documents proving the right to use the land and building to the factory establishment approval application on Form No. 5, and if deemed approvals such as farmland conversion or development activity permits are sought, also submit the permit statement and documents required by the relevant laws. The processing period is 7 to 20 days depending on the scope of deemed approvals.

  4. 04

Manage construction start and schedule: approval may be revoked if construction does not begin within 3 years of approval (2 years if farmland conversion is deemed approved) or if the completion report is not filed within 4 years after approval, so the construction schedule should be managed around these deadlines.

  5. 05

Completion report and factory registration: file the completion report within 2 months from the date the final building use approval is obtained and machinery installation is completed, and have the on-site inspection confirm that the business plan, manufacturing process chart and actual equipment match. Factories under 500 square meters apply for registration using the factory registration application on Form No. 9.

  6. 06

Change of registration: if registered matters such as the company name, a decrease in factory site or building area, ancillary facility area or industry type change, submit the factory registration change application and supporting documents within 2 months. Deemed processing of modification permits or reports for emission facilities and hazardous materials facilities can also be requested at the time of change of registration.
