Preparation and Filing Guidance for Family-Relation Registration Reports

Preparing reports of changes in family relations such as birth, marriage and death is work of an administrative agent under Article 2(1)(b) of the Enforcement Decree of the Certified Administrative Agents Act. Under Article 20 of the Act on the Registration, etc. of Family Relationships, a report may be filed at the registration base of the person concerned or at the reporter's address or current location, and a report concerning a foreign national at their place of residence or the reporter's address or current location. A birth must be reported within 1 month after birth with a birth certificate from a doctor or midwife, and a death within 1 month of the person obliged to report learning of it with a medical certificate or post-mortem certificate; missing the deadline without good reason incurs a fine of up to 50,000 won under Article 122 of the same Act. A marriage report has no deadline but the marriage takes effect only when reported, and attachments written in a foreign language must be accompanied by a translation.

  • Notification Difficulty Low

You submit the statutory report form and required documents. Once the documents are in order the report is accepted; for some reports the authority checks the contents before accepting it.

  1. 01

Report type and deadline: decide the type of report (birth, marriage, death, adoption, acknowledgment, etc.) and check whether it has a deadline, such as 1 month after birth or 1 month from learning of a death, then calculate the date.

  2. 02

Who reports: there are persons legally obliged to report, such as the parents for a birth and relatives living together for a death, and a marriage requires the signatures of both parties and two adult witnesses, so decide first who will sign.

  3. 03

Prepare attachments: gather the attachments for each type of report, such as a birth certificate (or a document proving the birth if born outside a hospital), a medical or post-mortem certificate, and documents issued by foreign authorities with translations. A marriage with a foreign spouse requires a certificate on the marriage requirements issued by the spouse's home-country authority.

  4. 04

Fill in the report: use the form set by the Supreme Court established rules, write in Korean and Arabic numerals, add Chinese characters to the name of the person concerned and write the family origin in Chinese characters. A child's name may use only Korean or commonly used Chinese characters.

  5. 05

File the report: file at the city (district), town or township office of the registration base or the reporter's address or current location, or report online through the electronic family relationship registration system. Reports concerning Korean nationals abroad can also be filed at the Family Registration Office for Overseas Koreans.

  6. 06

Confirm processing: once accepted, the report is entered in the family relationship register, so obtain a family relation certificate and basic certificate to check the entries, and if they differ, ask the office where it was filed how to correct them.
