Establishment of a Farming Association Corporation

A farming association corporation is a corporation in which 5 or more farmers or agricultural producer organizations jointly invest to run a cooperative farm business under Article 16 of the Act on Fostering and Supporting Agricultural and Fisheries Business Entities. After drafting articles of incorporation and holding an inaugural general meeting, an establishment report is filed with the city, county or district of the main office, and the establishment is registered within 14 days from receiving the report certificate. There is no legal minimum total investment, and business registration and corporate agricultural business entity registration after establishment are needed for policy support and tax reductions. If members fall below 5, they must be replenished within 1 year.

You submit the statutory report form and required documents. Once the documents are in order the report is accepted; for some reports the authority checks the contents before accepting it.

  1. 01

Check member composition: 5 or more farmers or agricultural producer organizations such as agricultural cooperatives must be members. Documents showing that members are farmers, such as an agricultural business entity registration certificate or farmer confirmation, are submitted at establishment registration, so obtain them in advance.

  2. 02

Articles of incorporation and inaugural general meeting: Include the business purpose, investment method, joining and withdrawal of members, voting method and distribution of surplus in the articles, adopt the articles at the inaugural general meeting, elect the representative director and directors, and prepare the minutes.

  3. 03

Make the investments: Carry out cash investments and in-kind investments such as farmland or grassland. Align each member's investment amount and role and the handling of shares upon withdrawal with the articles.

  4. 04

Establishment report and registration: File an establishment report with the city, county or district of the main office, and apply for establishment registration with the report certificate attached within 14 days from receiving it.

  5. 05

Business registration and agricultural business entity registration: After registration, register the business at the tax office and register as a corporate agricultural business entity. Policy support and tax reductions apply only after this registration.
