Permit to Establish Hazardous Materials Manufacturing/Storage/Handling Facilities

To install a manufacturing facility, storage facility or handling facility (collectively, a hazardous materials facility) that stores or handles hazardous materials at or above the designated quantity, or to change its location, structure or equipment, a permit must be obtained from the mayor or governor of the city/province where the facility is located under Article 6 of the Safety Control of Hazardous Substances Act, and filings and inspections are actually handled by the competent fire station. If only the product name, quantity or multiple of the designated quantity changes without changes to location, structure or equipment, a report must be filed by 1 day before the change, and facilities such as manufacturing facilities or general handling facilities handling 1,000 times or more of the designated quantity and outdoor tank storage of 500,000 liters or more go through a technical review by the Korea Fire Industry Technology Institute (Article 6 of the Enforcement Decree of the same Act). After construction, each facility may not be used until it passes a completion inspection confirming compliance with technical standards (Article 9). A hazardous materials safety manager must be appointed for each facility and reported to the head of the fire headquarters or fire station within 14 days of appointment, and if the manager is dismissed or resigns, a new manager must be appointed within 30 days (Article 15).

Procedure

Procedure

Procedure type
  • Permit Difficulty High

A procedure that allows a business, activity or stay that the law generally restricts, after review; licenses fall into this type. The authority reviews facility standards, location and consultation with other agencies, and a permit can be refused if the standards are not met.

  1. 01

Confirm whether a permit is required: list the class, product name and maximum quantity of hazardous materials to be stored or handled, calculate the multiple of the designated quantity, and determine which type of facility applies, such as a manufacturing facility, indoor storage, tank storage or general handling facility. Storage for residential heating and storage of 20 times or less of the designated quantity for agricultural, livestock or fisheries heating or drying facilities may be installed without a permit.

  2. 02

Review technical standards: use the layout plan to check whether safety distances and clearance space, building structure, ventilation and exhaust equipment, and fire extinguishing, alarm and evacuation equipment meet the location, structure and equipment standards of the Enforcement Rule. For facilities subject to technical review, obtain the Korea Fire Industry Technology Institute review first and attach the result to the permit application.

  3. 03

Prepare the permit application: attach to the application on Form No. 1 or Form No. 2 of the Enforcement Rule of the Safety Control of Hazardous Substances Act the drawings showing site layout, equipment layout and process outline, and electrical, lightning protection, fire extinguishing, alarm and evacuation equipment, together with the structural equipment specification sheet for the facility, and submit it to the competent fire station.

  4. 04

Construction and tank inspection: proceed with construction after the permit, and if there are hazardous materials tanks, obtain the tank safety performance inspection and keep the pass certificate. For piping subject to pressure or non-destructive testing, keep the test pass documents in preparation for the completion inspection.

  5. 05

Apply for the completion inspection: after installation, apply using Form No. 22 or Form No. 23 with the piping test pass documents and tank inspection pass certificate attached, and use the facility only after receiving the completion inspection pass certificate.

  6. 06

Appoint the safety manager and ongoing management: appoint a qualified safety manager for each facility and report the appointment within 14 days. If the safety manager is dismissed or resigns, appoint a new one within 30 days and designate a deputy to perform the duties in the meantime.
