Procedure
- Permit Difficulty High
A procedure that allows a business, activity or stay that the law generally restricts, after review; licenses fall into this type. The authority reviews facility standards, location and consultation with other agencies, and a permit can be refused if the standards are not met.
- 01
Classify the business type: First decide whether it is a transport business that carries cargo for pay with your own trucks (general trucking with 20 or more vehicles, individual trucking with 1 vehicle), a brokerage business that brokers or acts on transport contracts without vehicles, or a franchise transport business that runs a network of member operators. Permit standards and what can be taken over differ by type.
- 02
Check whether a new permit is possible: For a transport business, only the exception vehicle types in the Supply Standards can receive a new permit, such as parcel delivery trucks (maximum payload of 2.5 tons or less), towed vehicles, and road-sweeping or cleaning vehicles that the metropolitan mayor or provincial governor judges necessary for the region. For a brokerage business, new permits are prohibited in principle for both the main office and branch offices.
- 03
Review the business to be taken over: Before signing, check the transferor's permit details and number of vehicles, and whether the transferee or any officer of a corporate transferee falls under a disqualification ground. A transport business can be transferred only after 2 years from the date the transferor obtained the permit or acquired the business (6 months for individual trucking not limited to parcel collection and delivery), the whole business is transferred in principle, and some permits such as temporary permits cannot be transferred.
- 04
Prepare the requirements: For a transport business, prepare a cargo transport worker qualification certificate for everyone who will drive the acquired vehicles, and a garage installation confirmation that the city, county or district where the garage is located issues within 10 days of the application. For a brokerage business, secure an office with the floor area needed for the business.
- 05
File the transfer and acquisition report: The transferee submits the transfer and acquisition report with a copy of the contract and the requirement documents to the competent authority. The authority notifies whether it accepts the report within 5 days of receiving it, and once accepted, the transferee takes over the operator status together with the consignment contracts with owner-drivers on the same terms.
- 06
Manage follow-up reports: File a report on permit standards every 5 years (individual trucking operators excluded) and report transport or brokerage results. For a transport business, adding vehicles or moving the main office outside the jurisdiction requires a permit for change, while a change of trade name or representative (for a corporation) and vehicle replacement require a change report; a brokerage business files its change report with the competent association.
