General Travel Agency Change Registration (Conversion from Domestic or Domestic-Overseas Travel Agency)

A business that has operated as a domestic travel agency or a domestic-overseas travel agency must file a tourism business change registration to become a general travel agency under Article 4 of the Tourism Promotion Act if it wants to handle travel for foreign visitors (inbound). The change registration is filed with the city, county or district office having jurisdiction over the office location within 30 days of the date the reason for the change arises, by attaching documents proving the change to the tourism business change registration application. The capital requirement for a general travel agency is 50 million won or more (assessed asset value for individuals), and while there is no need to set up a new company, the registration standards are reviewed at the same level as for a new registration. The capital increase registration, revision of the business purposes in the articles of incorporation and increase of the guarantee insurance must be completed before applying, and the registration standards must be maintained as long as the business operates.

    The authority checks whether the statutory registration requirements, such as facilities, staff and capital, are met before issuing a registration certificate. Registration can be refused if the requirements are not met.

    Check the registration standards: The capital requirement is 50 million won or more for a general travel agency and 30 million won or more for a domestic-overseas travel agency, and since the office must be in a building with a suitable use on the building register, recheck the current office as well.

    Meet the capital requirement: A corporation that lacks sufficient capital completes the capital increase registration first, while a sole proprietor proves the capital requirement with a statement of business assets and supporting evidence.

    Revise the business purposes: If the business purposes in the articles of incorporation do not include general travel business or wording that covers it, amend the articles and prepare the amended articles and corporate registration certificate for the application.

    Increase the guarantee insurance: The coverage amount of travel agency guarantee insurance is set by business type and sales in the previous business year, so obtain a policy with coverage raised to the general travel agency standard.

    Apply for the change registration: Within 30 days of the reason for the change arising, submit the change registration application, business plan, proof of capital and guarantee insurance policy to the city, county or district office. The financing plan in the business plan should match the financial statements and proof of capital to reduce requests for corrections.

    After registration: Once the new tourism business registration certificate is issued, update the business type on the business registration, the website, travel terms and conditions, and business cards, and keep meeting the registration standards such as capital and guarantee insurance.
