- Permit Difficulty High
A procedure that allows a business, activity or stay that the law generally restricts, after review; licenses fall into this type. The authority reviews facility standards, location and consultation with other agencies, and a permit can be refused if the standards are not met.
- 01
Check protection zone and preservation area status: Confirm through the land use plan certificate and public notices whether the parcel lies within the protection zone of a designated heritage or within a historical and cultural environment preservation area set by ordinance. Specific activity standards are publicly notified for each heritage, so first compare the planned height and scale of the building against those standards.
- 02
Identify the permit type and permitting authority: Building or extending structures, planting or removing trees, and excavation or filling within a protection zone require an alteration permit (Article 35(1)1), while acts in a preservation area that may affect the landscape or preservation require a permit under item 2. Minor acts prescribed by Presidential Decree, such as installing information or warning signs, are permitted by the mayor, county head or district head, and city or provincial designated heritage follows the ordinance procedure.
- 03
Prepare the application and plan: For alterations within a protection zone use Enforcement Rule Form No. 19, and for acts in a preservation area use Form No. 19-2, stating the name, type and location of the heritage and the details of the act. The alteration plan or activity plan sets out the location, scale and method of the works and their effect on the heritage.
- 04
Check drawings and site photos: Attach relevant drawings such as a location map and site plan together with site photos; where cutting, filling or installing facilities in a preservation area, a site plan, floor plan, elevation, section and site cross and longitudinal sections are required. Design drawings are prepared separately, and for buildings subject to report under Article 14 of the Building Act, drawings may be omitted for a preservation area activity permit.
- 05
Submit through the city, county or district and respond to supplementation: The application goes to the Administrator of the Korea Heritage Service through the competent mayor, county head or district head, who notifies the city or provincial governor. Supplementation periods do not count toward the 30-day processing period, so submit supplementary documents promptly with figures matching the plan and drawings.
- 06
Respond to deliberation and receive the permit: Where necessary, an expert investigation and committee deliberation take place, and if deliberation is held, the result is notified within 7 days after it ends. Carry out the works in accordance with the permit period and conditions stated on the permit, and apply for a change permit using Form No. 22 to modify permitted matters.

If the design is finalized at a height or scale exceeding the notified activity standards before applying, it may fail the permit criteria and require redesign, so check the preservation area activity standards and whether a permit is needed before buying land or finalizing the design.
