Information Disclosure Requests · Objection Documents

An information disclosure request is a procedure under Article 10 of the Official Information Disclosure Act in which a request form stating the requester's personal details and the content and method of disclosure sought is submitted to the public institution that holds or manages the information; requests can also be filed through the Information Disclosure Portal. The institution decides whether to disclose within 10 days of receiving the request and may extend this by up to 10 days for unavoidable reasons (Article 11); when it decides not to disclose, it must state in writing which item of Article 9(1) applies and how to appeal (Article 13). If the requester objects to a non-disclosure or partial disclosure decision, or no decision is made within 20 days of the request, an objection may be filed in writing with the institution within 30 days of receiving the notice or of the 20th day after the request, and the institution decides within 7 days of receipt (Article 18). An administrative appeal may also be filed directly without an objection (Article 19).

Procedure

Procedure

Procedure type
  • Application Difficulty Medium

An application for a subsidy, benefit, compensation or decision. The authority reviews whether the payment or selection criteria are met and then decides.

  • Appeal Difficulty High

Submitting an opinion, objection or administrative appeal against a disposition or decision already made, or applying for damage relief or dispute mediation. The reviewing body decides after examining the facts and the law, so preparing supporting evidence is important.

  1. 01

Specify the information requested: Clues for locating the information, such as the document title, date prepared, responsible department and case number, are stated, and the disclosure method (inspection, copies or electronic files) is chosen. Information held by another institution is transferred to the competent institution, and requests closer to complaints or inquiries may be handled as civil petitions (Article 11(4) and (5)).

  2. 02

Submit the request form: The information disclosure request form (Annex Form No. 1-2 of the Enforcement Rules) is filed via the Information Disclosure Portal, mail, fax or in person. Information already published online may be answered by pointing to its location, and a repeated request for the same information without good reason after receiving a decision may be closed (Article 11-2).

  3. 03

Check the decision notice: The institution decides within 10 days of receipt and, if it extends the period, must notify the extension and reason in writing. If the information concerns a third party, the third party is notified and may request non-disclosure within 3 days of the notice (Article 21).

  4. 04

Review the grounds for non-disclosure: Each item of Article 9(1) cited in the notice is examined. Non-disclosure grounds are limited to eight, personal information (item 6) excludes the names and positions of officials performing duties and information needed for remedying rights, and parts that can be separated must be disclosed (Article 14).

  5. 05

File an objection within 30 days: Within 30 days of receiving the decision notice (or of the 20th day after the request if no decision is made), an objection form (Annex Form No. 9 of the Enforcement Rules) stating the purpose and reasons is filed with the institution. The institution decides within 7 days of receipt and may extend this by up to 7 days for unavoidable reasons.

  6. 06

File an administrative appeal: If the objection is dismissed or rejected, or to challenge the decision without an objection, an appeal is filed under the Administrative Appeals Act within 90 days of learning of the disposition and within 180 days of the disposition. Hwang Yunsang Administrative Office prepares and submits on the client's behalf the disclosure request form, the objection form and the administrative appeal petition.
