Employment and Labor Authority Complaints and Administrative Documents

Workers who have not been paid wages or severance pay can file a wage arrears petition with the regional employment and labor office with jurisdiction over the workplace, and a labor inspector confirms the arrears and amount through interviews with both parties. Article 36 of the Labor Standards Act requires all money including wages to be paid within 14 days of leaving the job, and under Article 49 of the same Act wage claims expire by prescription if not exercised for 3 years. If the employer still does not pay, a simplified substitute payment under the Wage Claim Guarantee Act may be claimed: a worker who has left must have filed a petition or similar within 1 year from the day after leaving, and must claim within 6 months from the date the certificate of unpaid wages and employer confirmation was first issued. Hwang Yunsang Administrative Office prepares the petition, wage calculation sheet and list of evidence and submits them on the client's behalf.

Procedure

Procedure

Procedure type
  • Appeal Difficulty High

Submitting an opinion, objection or administrative appeal against a disposition or decision already made, or applying for damage relief or dispute mediation. The reviewing body decides after examining the facts and the law, so preparing supporting evidence is important.

  1. 01

Organize the employment relationship and arrears: write down start and end dates, workplace, agreed wages and amounts received in date order, and make a calculation sheet of monthly unpaid amounts and severance pay. Wages older than 3 years expire, so check the period first.

  2. 02

Secure evidence: even without an employment contract, the employment relationship can be shown with wage transfer records, attendance records, work schedules, work instruction messages and social insurance enrollment history, so collect them as original files.

  3. 03

Draft and file the petition: file a petition stating workplace details, period of employment, amounts by arrears item and demands through the Ministry of Employment and Labor's labor portal or with the regional employment and labor office for the workplace.

  4. 04

Prepare for the interview: once an inspector is assigned, an attendance date is notified. Organize the key points of your statement with the calculation sheet and evidence list, and secure the date first because failing to attend without good reason can close the case.

  5. 05

Confirmation of arrears and substitute payment claim: if arrears are confirmed, obtain the certificate of unpaid wages and employer confirmation and claim the simplified substitute payment from the Korea Workers' Compensation and Welfare Service within 6 months of its first issuance. A worker who has left is eligible only if the petition was filed within 1 year from the day after leaving.

  6. 06

Wrap-up: if the employer pays, check the deposit and close the case; after receiving the substitute payment, keep the certificate and investigation records so the remaining arrears can be claimed separately.
