Land Development Permits (Development Activity Permit, Land Subdivision, Land Category Change, Development Charges)

Changing the form or quality of land, installing structures, extracting earth and stone, subdividing land, and stacking goods for one month or longer in green, management or natural environment conservation areas require a development activity permit under Article 56 of the National Land Planning and Utilization Act. In Incheon, this authority is delegated to the heads of autonomous districts and counties under Article 84 and Appended Table 3 of the city's Urban Planning Ordinance. A decision is made within 15 days of application, but any period spent on urban planning committee review or consultation with other agencies is not counted toward the 15 days (Article 54 of the Enforcement Decree). After the works are completed, a completion inspection is required, and an application for land subdivision or land category change must be filed with the cadastral authority within 60 days from the date the use changed (Articles 79 and 81 of the Act on the Establishment and Management of Spatial Data). For projects subject to development charges (660㎡ or more in urban areas of metropolitan cities, among others), a development cost statement must be submitted to the district office within 40 days from the end of the charge assessment period (Article 24 of the Restitution of Development Gains Act and Article 25-2 of its Enforcement Decree).

Procedure

Procedure type
  • Permit Difficulty High

A procedure that allows a business, activity or stay that the law generally restricts, after review; licenses fall into this type. The authority reviews facility standards, location and consultation with other agencies, and a permit can be refused if the standards are not met.

  1. 01

Check permit requirements and deemed permits: Confirm the zoning through the land use plan certificate, the permitted scale by zone, and whether urban planning committee review is required. At this stage, also decide whether other permits, such as a private road opening permit, road occupation permit or road connection permit, will be processed together with the development activity permit.

  2. 02

Prepare and file the application: Attach proof of the right to use the land, a site layout, and design documents and cost breakdowns for hazard prevention, pollution prevention, landscape and planting to the Development Activity Permit Application (Form No. 5 of the Enforcement Rule) and file it with the district office; electronic filing through the national land use information system is also available.

  3. 03

Deemed permit documents and permit conditions: To obtain permits under other laws at the same time, the documents required by those laws must be submitted with the development activity permit application (Article 61 of the Act). If the permitting authority intends to attach conditions on infrastructure or hazard prevention, it must first hear the applicant's opinion, and a written opinion is submitted at that point.

  4. 04

Completion inspection: After completing land form changes, structure installation or earth and stone extraction, file without delay a Development Activity Completion Inspection Application (Form No. 6) with completion photos and, where required, a cadastral survey result map. For buildings, the use approval under the Building Act replaces this inspection.

  5. 05

Land subdivision and land category change: When the use of part of a parcel has changed or a reason for changing the land category arises, apply to the cadastral authority within 60 days from that date. Attach a copy of the subdivision permit for land requiring one, and a copy of the document proving completion of works for a land category change.

  6. 06

Submit the development cost statement: If the project is subject to development charges, submit the statement with evidence of construction, design and survey costs within 40 days from the end of the assessment period. The district office gives advance notice of the expected charge within 60 days of submission, and an objection may be filed as a pre-assessment review request within 30 days of receiving that notice.

If the development cost statement is not submitted within 40 days, a fine of KRW 1,000,000 applies, and if it is not submitted within three months from the end of the assessment period or is submitted falsely, the fine is KRW 2,000,000 (Article 29 of the Enforcement Decree). The 60-day land category change deadline and the 40-day statement deadline start together right after completion, so cost evidence should be organized when applying for the completion inspection.
