- 01
Check the prior notice of disposition: If a prior notice arrives before the license disposition, first check the planned disposition and the opinion submission deadline. Criminal proceedings and the license disposition run separately, so record the two schedules separately.
- 02
Organize the testing circumstances: Organize by time the time of drinking, boarding and navigation times, the time and method of testing, the testing equipment and whether a retest was done. Checking whether there were problems with the testing procedure and the classification of the reading is the core of the opinion submission.
- 03
Prepare and submit the opinion statement: Submit an opinion statement containing your arguments on the facts and testing procedure, with supporting materials, to the disposing authority within the deadline. If the reading is near a threshold, document the gap between the testing time and the time drinking ended.
- 04
Prepare livelihood and prevention materials: Also prepare proof of sea service, seafarer wage records, dependents' circumstances, completion of sobriety education and a recurrence prevention plan. Because the law sets dispositions by blood alcohol range, these materials are submitted as reference.
- 05
File an administrative appeal and stay of execution: After the disposition, file an administrative appeal within 90 days of learning of the disposition or within 180 days of the disposition. If a voyage schedule is at stake, consider applying for a stay of execution at the same time.
