Registration of Measuring Device Management Agency (Stack and Water Quality TMS)

A measuring device management agency, which manages automatic stack and water quality measuring devices on behalf of workplaces, must register under Article 32-2 of the Clean Air Conservation Act and Article 38-6 of the Water Environment Conservation Act by meeting the facility, equipment and technical personnel standards: Table 3-3 of the Enforcement Decree of the Clean Air Conservation Act for the air field and Table 8-2 of the Enforcement Decree of the Water Environment Conservation Act for the water field. The application goes to the head of the Basin Environmental Office or Regional Environmental Office with jurisdiction over the office location (including the Metropolitan Air Quality Management Office for the air field). The standards require a laboratory, measuring equipment for the listed items in each field, and technical personnel: 3 for air (at least 1 each in categories A, B and C) and 3 for water (at least 1 in category A and at least 2 in category B). Persons under adult guardianship, undischarged bankrupts, persons within 2 years after a prison sentence for violating the Act, persons within 2 years after registration cancellation, and corporations with such a person as an officer cannot register.

  • Registration Difficulty Medium

The authority checks whether the statutory registration requirements, such as facilities, staff and capital, are met before issuing a registration certificate. Registration can be refused if the requirements are not met.

  1. 01

Confirm the registration field: Decide first whether to manage stack (air) devices or water quality devices. The governing Act, equipment items and personnel qualifications differ by field, so registering in both requires meeting each standard.

  2. 02

Check personnel qualifications and numbers: The air field needs one person each in categories A (for example, Air Environment Engineer with 2 years of experience), B (for example, air-field Environmental Measurement Analyst) and C (for example, an engineer in electrical, electronic or information and communication fields). The water field needs at least 1 person such as a Water Environment Engineer or higher and at least 2 engineers in environment, chemical, mechanical, electrical or electronic fields; a representative who holds a qualifying credential may be counted.

  3. 03

Secure the laboratory and equipment: Provide a laboratory and equipment for sulfur dioxide, nitrogen oxides, carbon monoxide, oxygen, dust, hydrogen chloride, ammonia, hydrogen fluoride, flow rate and temperature (air), or pH, total organic carbon, suspended solids, total nitrogen and total phosphorus (water). Joint-use, lease or measurement agency contracts may count as having the equipment, so confirm the contract terms.

  4. 04

Check disqualification grounds and corporate officers: Confirm that the representative and officers do not fall under the disqualification grounds in Article 32-2(2) of the Clean Air Conservation Act (Article 38-7 of the Water Environment Conservation Act for water). If even one officer is disqualified, the whole corporation cannot register, so resolve this before applying.

  5. 05

Prepare and submit the application: Submit Form No. 12-3 (air) or Form No. 23-3 (water) with the holdings of facilities, equipment and personnel and supporting documents to the competent environmental office for the office location. The water field also requires a business plan. The official checks national technical qualifications and the corporate registry or business registration through shared administrative information, and any supplementation request must be answered by the deadline.

  6. 06

Receive the certificate and meet post-registration duties: The environmental office issues the registration certificate. Afterward, file a performance report with contracts attached by January 31 each year and keep a copy for 3 years, and apply for change registration when the name, representative, office or laboratory location, or registered technical personnel change.
