Procedure
Procedure
- Appeal Difficulty High
Submitting an opinion, objection or administrative appeal against a disposition or decision already made, or applying for damage relief or dispute mediation. The reviewing body decides after examining the facts and the law, so preparing supporting evidence is important.
We will prepare a prior notification opinion, a hearing document, an objection form to the disposition office, an administrative appeal claim, and a document for suspension of execution, step by step. We will first check the actual notice and statutory application requirements.
Scope & fee
- Basic scope
- We will review 1 notice of disposition and the provided evidence and prepare a request for administrative appeal on the merits. Prior notification opinion, hearing, appeal to the disposition office, and suspension of execution are each separate optional procedures. Identifying the disposition and its basis: Check the title, legal provision, facts behind the disposition, opinion deadline, and appeal notice in the disposition or prior notice. The way to challenge it differs depending on whether it is a refusal of an application or the cancellation of an existing permit or imposition of an obligation.
- 02
Opinion and hearing: At the prior-notice stage, submit an opinion and supporting materials to the agency named in the notice by the deadline. If a hearing applies, as with permit cancellation, notice arrives at least 10 days before the hearing, so prepare your statement and evidence in advance.
- 03
Deadlines and choice of route: Decide between an objection to the disposition authority within 30 days from receipt and an administrative appeal within 90 days from learning of the disposition. Even after an objection, you can file an administrative appeal within 90 days from notification of the result, so record that date.
- 04
Facts and supplementary materials: Organize in date order where the facts behind the disposition differ from reality, what has already been corrected or supplemented, and why documents were missing from earlier filings. If the basis for the disposition is unclear, obtain inspection and review records through an information disclosure request.
- 05
Administrative appeal and stay of execution: File with the provincial administrative appeals commission for dispositions by a city, county, or district head, and with the Central Administrative Appeals Commission for most dispositions by a provincial governor or national agency. For dispositions that immediately stop business or activities, such as cancellation of registration, also file a stay-of-execution application describing the serious harm and urgency.
- 06
Responding to the answer and after the decision: When the authority's answer arrives, add rebuttal materials in a supplementary brief. The decision is generally made within 60 days from the commission's receipt of the appeal and may be extended by 30 days; if the disposition is revoked or modified, check the authority's follow-up measures.
