Private Road Opening Permit and Road Occupation Permit Services (Access Roads for Landlocked Land)

To open, rebuild, extend or alter a private passage connected to a road under the Road Act or a rural road, a permit from the city mayor, county head or district head is required under Article 4 of the Private Road Act; the processing period on the statutory form is 7 days and there is no fee. The road structure must follow the standards for township and village roads under the Rural Roads Improvement Act (Article 5 of the Private Road Act), and the permit is refused if the applicant has no right to own or use the land or if the road would seriously harm the living environment of nearby residents or the safety of passage. Where the access road crosses public road land, a road occupation permit from the road management authority is required (Article 61 of the Road Act), and connecting a passage to roads designated by Presidential Decree requires a connection permit (Article 52); a facility with a connection permit is deemed to have an occupation permit. If land form changes are involved, the private road opening, road occupation and connection permits can be deemed granted together with the development activity permit (Article 61 of the National Land Planning and Utilization Act).

Procedure

Procedure

Procedure type
  • Permit Difficulty High

A procedure that allows a business, activity or stay that the law generally restricts, after review; licenses fall into this type. The authority reviews facility standards, location and consultation with other agencies, and a permit can be refused if the standards are not met.

  1. 01

Check the access route and the adjoining road: Confirm the land category and owners of the parcels the access road will cross using the land register and cadastral map, and determine which procedures are needed, among a private road opening permit, road occupation permit and connection permit, depending on whether the connecting road is a Road Act road, a rural road or an existing de facto road.

  2. 02

Secure the right to use land owned by others: Obtain a land use consent or contract that states the owner, the period of use, whether a fee is paid, and an agreement that the right of use carries over if ownership changes during the period. Without these items, the attachment requirements under Article 2 of the Enforcement Rule of the Private Road Act are not met.

  3. 03

Apply for the private road opening permit: Attach the plan drawing, construction plan, construction cost budget and plan, longitudinal and cross-section drawings to the private road opening permit application (Form No. 1 of the Enforcement Rule of the Private Road Act) and file it with the district or county office. Add a structural review for major structures such as bridges and a hydraulic review if the existing drainage system may be affected.

  4. 04

Apply for road occupation and connection permits: For the part using public road land, state the purpose, area, period and construction method on the road occupation permit application (Form No. 24 of the Enforcement Rule of the Road Act), attach electronic drawings, and file it with the road management authority. The processing period on the statutory form for metropolitan cities is 5 days for general occupation and 8 days for installing structures, and road excavation requires an opinion from the managers of major underground facilities.

  5. 05

Construction and use inspection: After construction, file a private road use inspection application (Form No. 3) with completion documents including drawings and photos showing the conditions before and after opening, and obtain a use inspection (processing period 7 days). The private road may not be used before the use inspection certificate is issued.

  6. 06

Management after opening: The road owner may not block public passage without a permit, and collecting a usage fee requires prior permission from the district office. If the status is transferred or inherited, the succession must be reported to the district office, and a road occupation permit must be extended before its period ends.
