Documents for Civil Servant Appeal Review

A public official who objects to a disciplinary action or to demotion, leave of absence, removal from position, or dismissal must, under Article 76 of the State Public Officials Act, file an appeal with the Appeals Commission within 30 days of receiving the written statement of reasons for the action; for any other adverse action taken against the official's will, the 30 days run from the day the official learned of it. Appeals by national public officials go to the Appeals Commission of the Ministry of Personnel Management, local public officials go to the local or education appeals commission of the metropolitan city or province, and teachers go to the Teachers' Appeals Commission. The commission decides within 60 days of receiving the appeal and may extend this by 30 days by resolution, and in an appeal against a disciplinary action it may not impose a heavier penalty than the original one. An administrative lawsuit against these actions can be filed only after the Appeals Commission has reviewed and decided the case.

Procedure type
  • Appeal Difficulty High

Submitting an opinion, objection or administrative appeal against a disposition or decision already made, or applying for damage relief or dispute mediation. The reviewing body decides after examining the facts and the law, so preparing supporting evidence is important.

  1. 01

Calculate the deadline: Confirm the date you received the statement of reasons or the personnel order notice and write down the 30-day deadline as a calendar date. If the notice arrived late, keep evidence of both the date printed on the notice and the date you actually received it.

  2. 02

Identify the competent commission: National public officials file with the Appeals Commission of the Ministry of Personnel Management, local government staff with the local appeals commission, education office staff with the education appeals commission, and teachers with the Teachers' Appeals Commission. An appeal filed with the wrong commission is transferred to the competent one.

  3. 03

Obtain the case records: Request access to, or file an information disclosure request for, the disciplinary resolution, the request for disciplinary resolution, the disciplinary committee minutes, and investigation and statement records, then compare the stated grounds with the actual facts.

  4. 04

Draft the appeal: Following the Regulations on Appeal Procedures, state your position and title, the respondent, the relief sought (revocation, modification, etc.), and the grounds and supporting evidence. Separate factual disputes, procedural defects, and arguments that the penalty is excessive, and support mitigation with records of commendations and service.

  5. 05

Submit and correct: Submit online, by email, in person, by mail, or by fax as the commission instructs. If the appeal has defects, the commission requests correction within 7 days of receipt, and failure to correct within the set period is treated as withdrawal of the appeal.

  6. 06

Review and decision: In dismissal or removal cases, the commission may, within 5 days of receipt, issue a provisional decision suspending the appointment of a successor. Attend the hearing to state your case or submit written opinions if you cannot attend; the decision is issued in writing as dismissal without merits, rejection, revocation, or modification.
