- Appeal Difficulty High
Submitting an opinion, objection or administrative appeal against a disposition or decision already made, or applying for damage relief or dispute mediation. The reviewing body decides after examining the facts and the law, so preparing supporting evidence is important.
- 01
Respond to requests for explanatory materials: If there are doubts about the report, a detailed investigation is followed by a request to submit explanatory materials. Materials submitted at this stage form the basis for the fine decision, and false or inaccurate materials can be subject to a separate fine, so submit them truthfully with contracts and remittance records.
- 02
Check the opinion submission deadline in the prior notice: When you receive a prior notice of a fine, check the violation, planned amount and opinion submission deadline. Opinions are in principle submitted once within the deadline set in the notice, so organize the circumstances and reduction grounds together with evidence at one time.
- 03
Organize evidence for reduction grounds: Attach documents showing that the late report or error occurred without intent or negligence, that it was promptly corrected, that there are financial difficulties, or that there was a justifiable reason for transferring the rental home. If you reported the violation first, also consider the self-report reduction.
- 04
Prepare and submit the opinion statement: Submit an opinion statement containing the circumstances, reduction grounds and a list of evidence to the reporting authority within the deadline. Rental business operators also organize materials on how the transfer occurred and measures taken to protect tenants.
- 05
Choose between voluntary payment and objection: Paying voluntarily within the opinion submission deadline reduces the fine by up to 20/100. If you file a written objection within 60 days of receiving the notice of imposition, the case moves to a court fine trial and the voluntary payment reduction does not apply, so weigh the benefit first.
