Preparation of documents for submission of safety and health plans, appointment of managers, and reporting of industrial accidents

The Occupational Safety and Health Act requires employers to submit plans and report appointments and accidents depending on the industry, number of regular workers, and processes. In manufacturing and similar industries, when installing or relocating all production facilities or installing designated machinery and equipment, two copies of the Hazard and Risk Prevention Plan must be submitted to the Korea Occupational Safety and Health Agency (KOSHA) at least 15 days before work begins, and for construction works above a certain scale by the day before construction starts; KOSHA notifies the review result (appropriate, conditionally appropriate, or inappropriate) within 15 days of receipt. When a safety manager or health manager is appointed, or that work is entrusted to a specialized institution, an appointment report must be filed with the competent regional employment and labor office within 14 days, while the appointment of the safety and health general manager and the safety and health manager in charge, and their performance of duties, must be documented and kept at the workplace. If a death or an injury requiring 3 or more days of leave occurs, an industrial accident investigation report must be submitted within 1 month of the accident, and a serious accident must be reported to the competent regional employment and labor office immediately upon becoming aware of it.

Confirm obligations: Review the industry, number of regular workers, facility installation or relocation plans, and construction scale to determine whether a Hazard and Risk Prevention Plan or Process Safety Report is required and whether a safety manager, health manager, or safety and health manager in charge must be appointed.

  2. 02

Calculate deadlines: Set dates for 15 days before work begins (manufacturing plans), the day before construction starts (construction plans), 30 days before facility installation starts (Process Safety Report), and within 14 days of appointment or entrustment (appointment reports).

Collect attachments: Gather floor plans of each building level, an overview and layout drawings of machinery and equipment, and an overview of work methods for handling raw materials and products. For construction works, prepare the documents in Annex 10 of the Enforcement Rule and obtain the opinion of a person qualified in construction safety.

  5. 05

Respond to the review result: If the result is conditionally appropriate, reflect the supplementary items in the notice. If an order to suspend construction or change the plan is issued after an inappropriate result, revise the plan and resubmit it to KOSHA.

Follow-up checks and accident reports: Keep the reviewed plan and result notice at the workplace, and receive KOSHA confirmation at the trial-run stage for facilities or every 6 months during construction.
