Preparation and submission of written opinions for students and guardians for the Student Guidance Committee

Under Article 18 of the Elementary and Secondary Education Act and the school rules, the head of a school may discipline a student who violates school rules, and Article 31 of the Enforcement Decree of the same Act sets five types of discipline: service within the school, community service, completion of special education, suspension of attendance (within 10 days per occasion and 30 days per year), and expulsion. Before imposing discipline, the head of the school must give the student or guardian an opportunity to state an opinion, and the student guidance committee established under the school rules deliberates on violations of school rules with no victim student, such as smoking, unexcused absence or cheating. Under the Guidelines on Preparing and Managing School Records, a period of suspension of attendance is treated as unexcused absence, and expulsion may be imposed only on high school students who are not in compulsory education. A student or guardian who objects to expulsion may request a review from the City/Provincial Student Discipline Adjustment Committee within 15 days from the date of the expulsion or within 10 days from the date of becoming aware of it.

Procedure

Procedure

Procedure type
  • Appeal Difficulty High

Submitting an opinion, objection or administrative appeal against a disposition or decision already made, or applying for damage relief or dispute mediation. The reviewing body decides after examining the facts and the law, so preparing supporting evidence is important.

We will write student and guardian opinions to submit to the school leadership committee. It supports organizing and submitting data and does not include committee attendance or statements.

Scope & fee
Basic scope
We will compile notices, facts, daily life, and guidance materials regarding a student's violation of school rules and write an opinion form for the student and guardian. It does not include retrials or administrative appeals after attendance at the Leading Committee, statements, and results. Scope of writing: 1 type of student/guardian opinion form, 5 pages per page. It does not include in-office submissions.
  1. 01

Check the notice and meeting schedule: From the notice to attend the student guidance committee received from the school, check the conduct cited as the ground for discipline, the meeting date and time, and the deadline and method for submitting a written opinion, and also request the school's rules on student discipline and the committee's operating rules.

  2. 02

Organize the facts and materials: Set out the date, place and circumstances of the conduct at issue in chronological order, and support any part that differs from what the school has found with verifiable materials such as messages, attendance records and medical records. Separate the parts the student admits from the parts in dispute.

  3. 03

Review the level of discipline: Article 31(2) of the Enforcement Decree requires the type of discipline to be applied in stages according to the seriousness of the ground, giving the student an opportunity to reform. Check whether it is a first violation and compare the school rules' standards for the same ground to set the direction of the written opinion.

  4. 04

Prepare and submit the written opinion: Hwang Yunsang Administrative Office prepares the written opinion of the student and guardian covering the facts, the student's usual conduct, attendance and academic situation, and measures to prevent recurrence such as a home guidance plan and participation in counseling, and submits it to the school within the deadline before the meeting.

  5. 05

Attend the meeting and state opinions: The student and guardian attend the student guidance committee and make their statement based mainly on the written opinion. If attendance is difficult, check with the school in advance whether a written opinion can replace the oral statement, and prepare the gist of answers to expected questions.

  6. 06

Check the result and challenge it: When notified of the result, check the type of discipline, the suspension period and how attendance is recorded. Expulsion may be challenged by a written request for review to the City/Provincial Student Discipline Adjustment Committee, which decides within 30 days, and a claimant who objects to that decision may file an administrative appeal within 60 days of receiving the notice.
