Registration application for reading rooms and preliminary review of registration eligibility for study cafes

Article 2 of the Act on the Establishment and Operation of Private Teaching Institutes and Extracurricular Lessons treats a facility that 10 or more people can use at the same time and that is provided as a place of study for 30 days or more as a private teaching institute (hagwon), and Article 2 of its Enforcement Decree defines a hagwon provided as a place of study as a reading room. Even if the business is named a study cafe, whether it must be registered as a reading room requires judgment when its actual operation is providing a study space, and operating without registration is punishable under Article 22 of the same Act by imprisonment of up to 1 year or a fine of up to 10 million won. Registration is made by filing a hagwon establishment and operation registration application with the competent education office; the building use must allow a reading room, such as a Class 2 neighborhood living facility (reading room), and the standards for reading areas, restrooms and lighting are set by city or provincial ordinances. Even before all facilities are ready, a conditional registration may be accepted on condition that the facilities are completed within 1 year.

The authority checks whether the statutory registration requirements, such as facilities, staff and capital, are met before issuing a registration certificate. Registration can be refused if the requirements are not met.

We will prepare the reading room registration documents and operating principles. Study Cafe will first review whether it is eligible for registration based on its actual operation type and building use.

It does not include facility construction, firefighting technology books, or actual business operations. Scope of writing: Reading room operation principles, 1 type, 5 pages per page. 1 office visit is included.
Study cafe preliminary assessment
We will review the actual operation mode and building use and facility data of 1 study cafe to guide you on whether or not it is eligible for registration as a reading room. This type does not include the actual reading room registration application. 1 office visit is included.
  1. 01

Decide whether registration is required: Under Article 2 of the Act, check whether 10 or more people can use the space at the same time and whether it is provided as a place of study for 30 days or more, organize the seating operation, pass structure and whether the space is study-only, and obtain the education office's judgment.

  2. 02

Check building use: In the building register, confirm that the floor's use allows a reading room, such as a Class 2 neighborhood living facility (reading room) under Annex 1 of the Enforcement Decree of the Building Act; if not, change the building use first.

  3. 03

Meet the facility standards: Check the competent city or provincial ordinance for reading area size and capacity, one reading desk per person, separate restrooms for men and women, and lighting and ventilation standards, finalize the floor plan, and install fire safety facilities under the fire safety laws.

  4. 04

Prepare the rules and usage fees: Draft the institute rules covering the reading room name, capacity, operating hours, closing days, usage fees and refund standards, and name the facility with its own name followed by "reading room".

  5. 05

File the registration: Submit the hagwon establishment and operation registration application with the rules, facility floor plan and proof of the right to use the premises to the competent education office. If the facility standards and educational environment are met, the registration is accepted and a registration certificate is issued.

  6. 06

Prepare for opening: Post the registration certificate and usage fees on site, join liability insurance or a mutual aid scheme covering users' life and bodily injury as required by ordinance, and check the local ordinance's operating rules such as late-night restrictions for minors.
