Construction Machinery Transfer Registration and Change of Registered Details — Checking Document Mismatches That Lead to Rejection
Construction machinery such as excavators, forklifts, dump trucks, loaders and cranes is registered with the registration office under Article 3 of the Construction Machinery Management Act. If the owner changes, or the trade name, head office, representative or principal place of use changes, a report of change in registered details must be filed within 30 days (6 months for inheritance) from the date of the change, and a transfer of title by sale (commonly called transfer registration) is handled as a report of change with a transfer certificate attached. The filing is refused if even a single digit of the chassis number on the transfer certificate differs, so first check that the documents match.
Procedure
- Registration Difficulty Medium
The authority checks whether the statutory registration requirements, such as facilities, staff and capital, are met before issuing a registration certificate. Registration can be refused if the requirements are not met.
1. Check the rights in the registration ledger
Check in the construction machinery registration ledger whether a mortgage or seizure has been registered. If one is registered, agree with the seller whether it will be cancelled before the balance is paid or whether the transferee will take over the machinery with it. Unless a cancellation registration is made, the mortgage or seizure record remains in the registration ledger even after the owner changes.
2. Check that the documents match
Check that the chassis number and the registration number on the transfer certificate do not differ from the registration ledger by even a single digit. The principal place of use may differ from the owner's address, but the report must state the place where the machinery is actually kept and operated.
3. Check documents according to commercial or private use
For commercial-use construction machinery, unlike private-use machinery, documents related to the rental business are also reviewed. If you do not have the documents that fit the use, you will be asked to supplement them.
4. File with the registration office
Submit the Report of Change in Construction Machinery Registration Details (with the transfer certificate attached for a sale) to the city or province (si/do) where the machinery is registered (or the city, county or district (si/gun/gu) if the authority has been delegated). Acquisition tax must be reported and paid by the date the report is filed, and urban railway bonds are purchased when applying for construction machinery registration, so they do not apply to a report of change of owner.
Required documents
- Report of Change in Construction Machinery Registration Details (a transfer of title by sale is also handled with this form)
- Transfer certificate (check that the chassis number and registration number match)
- Construction machinery registration certificate
- Identification or business verification documents of the transferor and the transferee
- Proof of the principal place of use
- Acquisition tax payment receipt
- For commercial use: documents related to the rental business
Fees
The government fee for a report of change in registered details is 1,000 won for 1 unit; a certified copy or extract of the registration ledger is 500 won per copy, and inspection is 100 won per case (free when inspected through the online civil petition service). Acquisition tax is separate and depends on the acquisition price of the machinery. Our office fee starts from the amount shown above and may vary depending on whether rights need to be settled, such as clearing a mortgage or seizure or conversion to a corporation; we will give you an exact quote after reviewing your documents.
