Construction Machinery Ownership Transfer and Registration Change

Construction machinery such as excavators, forklifts, dump trucks, loaders and cranes must be registered with the provincial or metropolitan governor under Article 3 of the Construction Machinery Management Act. When a registered item such as the owner, name (trade name), address or principal place of use changes, a report of change in registered particulars must be filed within 30 days of the change (within 6 months of the commencement of inheritance) under Article 5 of the Act and Article 5 of its Enforcement Decree. A change of owner through sale (commonly called a transfer registration) is handled through this report, attaching a certificate of transfer on Form No. 8-2 for direct sales or Form No. 8-3 for sales through a construction machinery dealer. The registration authority must notify whether the report is accepted within 3 days of receipt, and if the buyer does not file, the seller may file instead with documents proving the sale. Failing to report or filing a false report is subject to an administrative fine, so the deadline should be managed from the final payment date.

The authority checks whether the statutory registration requirements, such as facilities, staff and capital, are met before issuing a registration certificate. Registration can be refused if the requirements are not met.

  1. 01

Check rights in the registration ledger: Use a copy of the construction machinery registration ledger to confirm the current owner and any mortgage or seizure, and if one exists, agree with the seller on how and when it will be cancelled before the final payment.

  2. 02

Prepare the certificate of transfer: For a direct sale, fill in Form No. 8-2 (direct transaction) with the registration number, model and type, chassis number, sale date and the buyer's details, and obtain the seller's certificate of seal impression if sealed, or a confirmation of personal signature if signed.

  3. 03

Cross-check documents: Confirm that the chassis number and registration number on the certificate of transfer, registration certificate and inspection certificate match the ledger exactly, and that the principal place of use to be reported is where the machine is actually kept.

  4. 04

Acquisition tax and deadline: The buyer files and pays the acquisition tax directly and keeps the receipt, and the reporting deadline of 30 days from the sale date (final payment date), or 6 months from the commencement of inheritance, is calculated as a calendar date.

  5. 05

File the report of change: Submit the report on Form No. 8 with documents proving the change and the registration and inspection certificates to the registration authority, and receive the certificates with the change recorded once accepted. A change of name or address only is deemed reported through a move-in report and similar filings.

  6. 06

If the buyer does not file: When the seller files with proof of sale, the authority notifies the buyer to file within a period of 7 to 15 days, and if the buyer neither objects nor files in that period, the change reported by the seller is entered in the ledger.

Leaving the buyer's details blank on the certificate of transfer can lead to losses from unauthorized resale, and missing the 30-day deadline from the final payment exposes you to an administrative fine, so collect the documents on the payment date and file right away.
