Engineering Business Operator Report Requirements — 3 Technical Staff Including a Special-Grade Engineer and an Office

To conduct engineering activities such as design, supervision, feasibility studies, testing and inspection as a business, you secure technical staff and an office and report to the Minister of Trade and Industry as an engineering business operator. An engineering business needs at least 3 technical engineering engineers per specialized field, including 1 special-grade engineer, and an engineering consulting business needs at least 1 special-grade engineer. Acceptance is notified within 30 days of the report.

Procedure

Procedure type
  • Notification Difficulty Low

You submit the statutory report form and required documents. Once the documents are in order the report is accepted; for some reports the authority checks the contents before accepting it.

  1. 1. Decide the business type and specialized fields

An engineering business may perform all engineering activities, while an engineering consulting business may only perform research, planning, advice and guidance. Choose specialized fields (for example roads and airports, water supply and sewerage, air quality management) under technical sectors such as machinery, electricity, information and communications, construction and environment, and meet the standards for each field.

  2. 2. Secure technical staff

An engineering business needs at least 3 technical engineering engineers including 1 special-grade engineer, and a consulting business needs at least 1 special-grade engineer. Reporting a professional engineer counts as reporting 1 special-grade engineer and 1 junior engineer. Technical staff must be dedicated to engineering activities, and persons whose qualifications are suspended are excluded.

  3. 3. Secure an office and file the report

Secure an office needed for the work and attach proof of technical staff and the office to the report. The Minister of Trade and Industry notifies acceptance within 30 days and, if supplementation is needed, sets a period of up to 3 months for it.

  4. 4. Add specialized fields

To add a specialized field in the same technical sector, secure at least 3 technical engineering engineers including at least 1 senior-grade or higher engineer in that field, and add it through a report of change under Article 21, Paragraph 2 of the Act rather than a new business report.

  5. 5. Change, suspension, closure and succession reports

If the trade name, business location, representative, business type, specialized field or reported technical staff change, file a change report within 60 days. If you suspend business for 30 days or more or close, report within 30 days, and if you acquire or merge the business, file a succession report within 30 days.

Checked against the statutes on

Statutes and public notices change, so each case needs to be checked individually. Statute titles are given in English for reference. The Korean statutes are the authoritative text.

Check these first

  • Lending the report certificate to others or letting others do business under your name is grounds for loss of report validity.
  • After a loss of validity disposition, you cannot report again for 1 year from the disposition date.
