Land, buildings & compensation

Preparation of documents for land compensation consultation, adjudication, and objections

When land, a building or a business site is included in a public works project such as a road, housing site or power generation facility, compensation for loss is paid under the Act on Acquisition of and Compensation for Land for Public Works Projects (the Land Compensation Act). Land is appraised on the basis of the officially assessed price of reference land, and business, farming and leave-of-absence losses are examined separately against the requirements for each item. The compensation amount can be corrected at three stages, each with a fixed deadline: inspection of the land and goods protocols (the project operator's written records of the land and the objects on it), consultation, and adjudication.

Procedure

Procedure type
  • Appeal Difficulty High

Submitting an opinion, objection or administrative appeal against a disposition or decision already made, or applying for damage relief or dispute mediation. The reviewing body decides after examining the facts and the law, so preparing supporting evidence is important.

We will prepare land compensation consultation opinions and application/opinion documents related to expropriation decisions and objection decisions. This service does not include the entire appraisal and compensation negotiation.

Scope & fee
Documents for the consultation stage
We will prepare a consultation opinion by organizing the provided records and factual data for 1 land compensation case. Appraisal and on-site negotiation are not included. Scope of writing: 1 type of consultation opinion, 5 pages per type. It does not include in-office submissions.
Documents for the expropriation adjudication
We will prepare an application, opinion, and evidence related to the decision of 1 land expropriation case. The legal submission subject and claim route are confirmed, and appraisal and subsequent objection resolution are separate. Scope of writing: 1 type of acceptance decision application/opinion/5 pages per type. It does not include in-office submissions.
Documents for the objection adjudication
We will review the results of the acceptance decision and the grounds provided, and prepare application/opinion documents related to the objection decision. Preliminary consultation, new acceptance documents, and appraisal are not included. Scope of writing: 1 type of objection resolution application/opinion, 5 pages per type. It does not include in-office submissions.
  1. 1. Inspect the land and goods protocols and raise objections

When the project operator prepares the land protocol and goods protocol and makes them available for inspection, check the area, land category, state of use and any omitted obstacles (structures and other objects on the land) within the inspection period and raise an objection. Items missed at this stage are difficult to bring back in the later appraisal.

  2. 2. Secure records of the current state

Before the appraisal, photograph the current state, such as the inside and outside of buildings, signboards, warehouses and fences, and collect sales and lease materials that show the fact of business operation.

  3. 3. Check the requirements for each compensation item

Land is appraised on the basis of the officially assessed price of reference land, excluding development gains arising from the public works project concerned. For business loss, the business must have been operating continuously at a lawful place with human and physical facilities since before the date of public notice of project approval, etc. Farming compensation is based on 2 years of the average gross crop income per unit area of farm households in each province (do), and leave-of-absence compensation is based on 70% of average wages.

  4. 4. Consultation and request to purchase remaining land

The compensation amount is set as the arithmetic mean of the appraised values of 2 appraisal corporations (3 if the owner recommends one). If it is significantly difficult to use the remaining land for its previous purpose, you may request purchase of the remaining land no later than the project completion date.

  5. 5. Objection after adjudication

If consultation fails and an adjudication of expropriation is issued, you may file an objection with the Central Land Tribunal within 30 days from the date of receiving the authentic copy of the written adjudication. The deadline is short, so organize the issues as soon as the written adjudication arrives.

Checked against the statutes on

Statutes and public notices change, so each case needs to be checked individually. Statute titles are given in English for reference. The Korean statutes are the authoritative text.

  • Record the date each notice is received so that you do not miss the protocol inspection period or the 30-day deadline for objecting to the adjudication.

Frequently asked questions

Is land compensation set by the officially assessed individual land price?
No. It is appraised on the basis of the officially assessed price of reference land with similar use value, and development gains arising from the public works project concerned are excluded from the calculation.
Can I receive business loss compensation if I only have a business registration?
That alone is not enough. You must prove with sales and lease materials that the business had been operating continuously at a lawful place with human and physical facilities since before the date of public notice of project approval, etc.
The land protocol is wrong. By when must I raise an objection?
Within the protocol inspection period. If the area, land category, state of use or omitted obstacles are not corrected at this stage, they are difficult to reflect in the later appraisal.
What can I do if only part of my land is expropriated and the rest becomes useless?
You can request purchase of the remaining land. Where it is significantly difficult to use the remaining land for its previous purpose, the request must be made by the project completion date.
What can I do if I am dissatisfied with the amount in the adjudication of expropriation?
You may file an objection with the Central Land Tribunal within 30 days from the date of receiving the authentic copy of the written adjudication. After the deadline, the ways to contest it are greatly reduced.
Can an administrative agent prepare loss compensation documents for me?
Yes. Hwang Yunsang Administrative Office prepares objections to the protocols, requests to purchase remaining land and objections to adjudications of expropriation, organizes the supporting evidence, and submits them on your behalf.
