Preparation of documents for land compensation consultation, adjudication, and objections

When land, buildings or a business site are taken for a public project, the Act on Acquisition of and Compensation for Land for Public Works Projects requires the project operator to publish and notify a compensation plan containing the land and property inventories and make it available for inspection for at least 14 days; owners and interested persons may file a written objection to the inventories within that inspection period. If no agreement is reached after the public notice of project approval, the landowner may request in writing that the project operator apply for adjudication, and the operator must apply to the competent Land Tribunal within 60 days of the request, with an additional amount added to the compensation for any delay. A party dissatisfied with the expropriation ruling may file an objection with the Central Land Tribunal within 30 days of receiving the original ruling, and the deadline for an administrative lawsuit is 90 days from receipt of the ruling, or 60 days from receipt of the objection ruling if an objection was filed. Business losses are compensable only for businesses that had been operating continuously at a lawful location with personnel and facilities since before the date of public notice of project approval, and Hwang Yunsang Administrative Office prepares and files inventory objections, requests for adjudication, requests to purchase remaining land, and objections to expropriation rulings.

Procedure

Procedure

Procedure type
  • Appeal Difficulty High

Submitting an opinion, objection or administrative appeal against a disposition or decision already made, or applying for damage relief or dispute mediation. The reviewing body decides after examining the facts and the law, so preparing supporting evidence is important.

We will prepare land compensation consultation opinions and application/opinion documents related to expropriation decisions and objection decisions. This service does not include the entire appraisal and compensation negotiation.

Scope & fee
Documents for the consultation stage
We will prepare a consultation opinion by organizing the provided records and factual data for 1 land compensation case. Appraisal and on-site negotiation are not included. Scope of writing: 1 type of consultation opinion, 5 pages per type. It does not include in-office submissions.
Documents for the expropriation adjudication
We will prepare an application, opinion, and evidence related to the decision of 1 land expropriation case. The legal submission subject and claim route are confirmed, and appraisal and subsequent objection resolution are separate. Scope of writing: 1 type of acceptance decision application/opinion/5 pages per type. It does not include in-office submissions.
Documents for the objection adjudication
We will review the results of the acceptance decision and the grounds provided, and prepare application/opinion documents related to the objection decision. Preliminary consultation, new acceptance documents, and appraisal are not included. Scope of writing: 1 type of objection resolution application/opinion, 5 pages per type. It does not include in-office submissions.
  1. 01

Inspection of the compensation plan and objection to inventories: Within the inspection period of at least 14 days, check the area, land category, use and any omitted structures or trees in the land and property inventories and file a written objection with the project operator. If you were never notified of the plan, you may object until the consultation is completed.

  2. 02

Nominating an appraisal firm: Landowners may nominate an appraisal firm within 30 days after the inspection period ends. The nomination must be supported by proof of consent from owners of at least half of the affected land area and a majority of all owners, so neighbours' consent is gathered during this period.

  3. 03

Organizing materials during consultation: During the consultation period stated in the request for compensation consultation (at least 30 days unless there is a special reason), compare the appraisal results and compensation items line by line. Business losses are supported with sales, lease and permit records, and remaining-land losses with location, shape and use records.

  4. 04

Request for adjudication: If no agreement is reached after the consultation period following the public notice of project approval, submit a request for adjudication to the project operator in person or by certified mail. The operator must apply to the competent Land Tribunal within 60 days of receiving the request.

  5. 05

Request to purchase or expropriate remaining land: If the remaining part of the land becomes extremely difficult to use for its previous purpose, request the project operator to purchase it, and if no purchase agreement is reached, request expropriation from the competent Land Tribunal by the project completion date. Compensation for a decrease in the value of the remaining land cannot be claimed once 1 year has passed from the project completion date.

  6. 06

Objection to the expropriation ruling: Within 30 days of receiving the original ruling, file an objection form with a copy of the ruling with the Central Land Tribunal (rulings of a local Land Tribunal are filed through that tribunal). Filing an objection does not stop the project or the expropriation, so relocation schedules are managed at the same time.
