Rural temporary-stay facility notifications and farmland-survey opinion documents
A rural stay shelter is a temporary building installed on farmland by a farmer, or a person who intends to engage in weekend or hands-on farming, for direct use as temporary lodging for farm work. It must have a total floor area of 33㎡ or less, the parcel must be at least 2 times the combined area of the shelter and any parking space, deck and similar facilities, and the farmland must adjoin a road usable by fire trucks; with these requirements met, you file a temporary building construction report with the mayor, county head or district head. After reporting, you must apply for a change to the farmland register within 60 days from the date of installation so the shelter is entered, and a consent for land use is required for farmland owned by another person. When the retention period ends, file an extension report, and on a parcel that already has a farm hut, the combined total floor area must not exceed 33㎡.
Procedure
- Notification Difficulty Low
You submit the statutory report form and required documents. Once the documents are in order the report is accepted; for some reports the authority checks the contents before accepting it.
We will prepare the construction report for 1 shelter building and 1 lot of farmland and the documents for registration in the farmland ledger after installation. The investigation/pre-notification opinion form will be prepared in a separate format and distinguished from the actual shelter conversion report. Drawings and construction materials are provided, but design, construction, and on-site visits are separate.

1. Check whether the farmland is eligible
A shelter cannot be installed on farmland designated as a disaster prevention district, a collapse risk area or a natural disaster risk improvement district. The farmland must adjoin a road where fire trucks can operate, including township, village and farm roads and de facto passages long used by residents. Farmland in an agricultural promotion zone is also eligible if the requirements are met.
2. Calculate the shelter and parcel area
The shelter's total floor area must be 33㎡ or less, and if eaves or similar parts project 1 m or more from the center line of the outer wall, the building area must also be 33㎡ or less. If a farm hut stands on the same parcel, the combined total floor area of the hut and shelter must be 33㎡ or less. The parcel must be at least twice the shelter's floor area plus any parking space and deck (including an outside septic tank), and parking spaces and decks must stay within the area set by Ministry of Agriculture, Food and Rural Affairs notice.
3. File the temporary building report
Submit a temporary building construction report with a site plan and floor plan to the mayor, county head or district head, and start installation only after reporting. If the farmland belongs to someone else, attach a consent for land use. The installation and management standards in the local building ordinance also apply, so check the ordinance before reporting.
4. Register in the farmland register within 60 days
Within 60 days of installing the shelter, apply to the head of the city, district, eup or myeon for a change of farmland use information so the shelter is entered in the farmland register. Entry in the register is one of the shelter requirements, and failure to apply is subject to a fine for negligence (1,000,000 won for the 1st violation).
5. Residential fire safety equipment and extension of the retention period
The shelter must have residential fire safety equipment installed. The retention period is up to 3 years, and it may be extended by up to 3 years each time for the number of times set by the building ordinance, which may be set at 3 or more times for shelters. To extend, submit an extension report with photos of the front, back and both sides taken within 1 month, no later than 7 days before expiry.
Required documents
- Temporary building construction report
- Site plan and floor plan of the temporary building
- Consent for land use (if the farmland is owned by another person)
- Farmland register change application (change of farmland use information)
- Land use plan confirmation and cadastral map (to check districts and adjoining roads)
- Report for extension of the retention period with current photos (when extending)
- Letter of authorization (when submission is delegated)
Fees
The fee for a temporary building construction report is set by the building ordinance of each city, county or district; under attached Table 1 of the Incheon Metropolitan City Building Ordinance (temporary buildings pay 5/10 of the fee) and the Yeonsu-gu civil petition handbook, it is 4,700 won for a total floor area of less than 200㎡. There is no fee for an application to change farmland use information in the farmland register. Our office fee starts from the amount shown above and may vary depending on the scope of the eligibility review, whether site and floor plans are ready, and whether farmland register entry and retention period extension are included; we will give you an exact quote after reviewing your documents.

- If you do not apply for a farmland register change within 60 days of installation, you are subject to a fine for negligence and the shelter does not meet its requirements.
