Preparation of school safety mutual-aid medical-benefit, review and further-review claim documents

Under the Act on the Prevention of and Compensation for Accidents at School, accidents that occur during educational activities, on the way to or from school, or on field trips can be compensated by the School Safety Mutual Aid Association (hakgyo anjeon gongjehoe). The parent or guardian files the claim through the School Safety Accident Compensation Support System. The right to receive mutual aid benefits lapses by prescription if it is not exercised for 3 years, so it is safest to claim within 3 years from the date of the accident. The claim can be made together with a claim under private indemnity medical insurance.

Procedure

Procedure type
  • Application Difficulty Medium

An application for a subsidy, benefit, compensation or decision. The authority reviews whether the payment or selection criteria are met and then decides.

  • Appeal Difficulty High

Submitting an opinion, objection or administrative appeal against a disposition or decision already made, or applying for damage relief or dispute mediation. The reviewing body decides after examining the facts and the law, so preparing supporting evidence is important.

We will prepare the initial claim for school safety mutual-aid compensation medical care benefits and the application documents for review and re-examination. We distinguish cases where a separate accident report is required from basic claims.

  1. 1. Tell the school about the accident

When an accident happens, tell the homeroom teacher or the school nurse so that the school records the accident and notifies the Association. Whether compensation is paid depends on when, where and during what activity the student was injured, so leave a specific record of how the accident happened.

  2. 2. Collect treatment records

Get a medical certificate, medical bill receipts and an itemized statement of medical expenses from the hospital. If treatment takes a long time, you can claim everything at once after treatment ends, but it is safest to schedule the claim within 3 years from the date of the accident. The Act does not set a separate starting point for the 3-year prescription, so depending on the type of benefit it may start later.

  3. 3. File the claim online

The parent or guardian logs in to the School Safety Accident Compensation Support System, claims mutual aid benefits and uploads the documents. Payment is usually made about 2 weeks after the claim.

  4. 4. Check the decision and challenge it if necessary

When a decision to pay or not to pay is issued, check its content. If you do not agree with the decision, you can file a request for examination with the School Safety Mutual Aid Compensation Examination Committee within 90 days from the date you became aware of the decision. If you also disagree with the decision on that request, you can file a request for reexamination within 90 days from the date you received the written decision.

Frequently asked questions

What is the deadline for a claim to the School Safety Mutual Aid Association?
It is 3 years. The right to receive mutual aid benefits lapses by prescription if it is not exercised for 3 years. The Act sets no separate starting point, so under the Civil Act the period runs from when the right can be exercised, but it is safest to prepare in advance and claim within 3 years from the date of the accident.
I already received a payout from my private indemnity medical insurance. Can I also claim from the School Safety Mutual Aid Association?
Yes. You can claim from both the Association and private indemnity medical insurance. However, handling may differ depending on the insurance policy terms, so also check the insurer's standards.
Is an injury on the way to or from school covered?
Under the Act on the Prevention of and Compensation for Accidents at School, accidents on the way to or from school and on field trips are covered, as well as accidents during educational activities. The accident statement must state whether the time and route of the accident were part of an ordinary trip to or from school.
Where do I file a claim with the School Safety Mutual Aid Association?
The parent or guardian files the claim online through the School Safety Accident Compensation Support System. Payment is usually made about 2 weeks after the claim.
