Foreigner Real Estate Acquisition Report and Land Acquisition Permit Documents

When a foreigner (an individual without Korean nationality, a corporation established under foreign law, or a corporation in which foreigners hold half or more of the officers, capital or voting rights, etc.) acquires real estate in Korea, Article 8 of the Act on Report on Real Estate Transactions requires a report to the city, county or district office where the property is located (the reporting authority). A sale contract is handled through the real estate transaction report under Article 3 of the same Act (within 30 days of the contract date); other contracts such as gifts must be reported within 60 days of the contract date; non-contractual acquisitions such as inheritance, auction, repurchase, final court judgment, merger or new construction within 6 months of acquisition; and continued holding after a change of nationality within 6 months of the change. Land in military base and military installation protection zones, designated cultural heritage and their protection zones, ecological and landscape conservation areas, special wildlife protection zones and similar areas requires a land acquisition permit under Article 9 before the contract is signed, and a contract made without the permit has no effect. All of Seoul and parts of Incheon (including Yeonsu-gu) and Gyeonggi are designated as foreigner land transaction permit zones (Aug 26, 2026 to Aug 25, 2027), so a foreigner buying a covered home there must obtain a land transaction contract permit before signing.

Procedure

Procedure

Procedure type
  • Notification Difficulty Low

You submit the statutory report form and required documents. Once the documents are in order the report is accepted; for some reports the authority checks the contents before accepting it.

  • Permit Difficulty High

A procedure that allows a business, activity or stay that the law generally restricts, after review; licenses fall into this type. The authority reviews facility standards, location and consultation with other agencies, and a permit can be refused if the standards are not met.

  1. 01

Confirm foreigner status: check nationality, the law under which a corporation was established, and the ratio of foreign officers, capital and voting rights to decide whether the buyer is a foreigner under the Act, and identify whether the acquisition is by sale, gift, inheritance, auction, new construction or change of nationality.

  2. 02

Review permit zones: use the land use plan to check whether the land falls in an Article 9 permit area such as a military installation protection zone, cultural or natural heritage protection zone, or ecological and landscape conservation area, and whether it meets the period, housing type and area criteria in the foreigner land transaction permit zone notice.

  3. 03

Apply for a permit before the contract: for Article 9 land, submit the foreigner land acquisition permit application with the agreement between the contracting parties to the reporting authority; the processing period is 15 days (30 days for national defense zones, extendable by up to 30 days). In a land transaction permit zone, attach a land use plan and a land acquisition funding plan to the land transaction contract permit application; once this permit is granted, a separate Article 9 permit is not needed.

  4. 04

Calculate reporting deadlines: set dates so that a sale is reported within 30 days of the contract (a licensed real estate agent reports brokered deals), other contracts such as gifts within 60 days, inheritance, auction or new construction within 6 months of acquisition, and continued holding within 6 months of the nationality change.

  5. 05

File the acquisition or continued holding report: submit the foreigner real estate acquisition and continued holding report with documents proving the cause of acquisition (gift contract, proof of heirship, auction award decision, etc.), a power of attorney and a copy of the principal's ID to the reporting authority, then deliver the report confirmation to the applicant.

  6. 06

Organize foreign exchange documents and next steps: if a non-resident acquires with funds remitted or brought from abroad, prepare the real estate acquisition report and transaction evidence for the foreign exchange bank, and organize the report confirmation and permit for the applicant's own later procedures such as ownership transfer registration.

The foreigner land acquisition permit and the land transaction contract permit must be obtained before the contract; a contract made without them has no effect and has to be redone. Foreigner land transaction permit zones can change in period and area by public notice, so check again right before signing.
