General and residential lodging business report preparation

Under Article 3 of the Public Health Control Act, a general lodging business may operate only after it has the required facilities and equipment and has filed a business report with the head of the city, county or district (si/gun/gu) where the premises are located; rooms with cooking facilities fall under the lodging business (residential) category instead. A business report certificate is issued immediately when the report is filed, and if the facilities need to be checked, the authority inspects the premises within 30 days after issuing the certificate. The building register must show the use as a lodging facility. Within an educational environment protection zone (within 200m of a school boundary), lodging is not allowed in the absolute protection zone (within 50m of the school gate), and in the relative protection zone it must first be excluded from the prohibited facilities after review by the regional educational environment protection committee of the education office. Facilities for farm and fishing village homestays, foreign tourist urban homestays and hanok experience businesses are excluded from the lodging business and follow the procedures of their own laws.

Procedure type
  • Notification Difficulty Low

You submit the statutory report form and required documents. Once the documents are in order the report is accepted; for some reports the authority checks the contents before accepting it.

We maintain the scope of the existing facility outline form of the general lodging business report, and for residential lodging businesses with cooking facilities with separate requirements for cooking facilities, number of rooms, and usage rights, we prepare and submit reporting documents for the corresponding type. Preliminary applications, deferred management, and change of use of residential lodging facilities with cooking facilities are handled separately.

  1. 01

Confirm the business type: Without cooking facilities, report as a lodging business (general); with them, as a lodging business (residential). First check whether the premises fall under the excluded facilities in Article 2 of the Enforcement Decree of the Public Health Control Act, such as farm and fishing village homestays, foreign tourist urban homestays or hanok experience businesses.

  2. 02

Check building use and educational environment protection zones: Confirm that the building register shows lodging use and that the land use plan imposes no restriction. If the site is within 200m of a school boundary, ask the education office whether it is in the absolute or the relative protection zone.

  3. 03

Educational environment protection zone review: In a relative protection zone, apply to the superintendent of education (or head of the education office) for exclusion of the prohibited activity or facility, and proceed with the business report after receiving the regional educational environment protection committee's decision. The absolute protection zone is not eligible for review.

  4. 04

Check the standards for reporting part of a building: To run lodging in part of a building under collective ownership, the rooms must occupy separate floors, or there must be 30 or more rooms, or the business area must be at least one third of the building's total floor area. Also check whether a local ordinance relaxes these standards.

  5. 05

Facility and safety preparation and hygiene education: Meet the facility standards in Annex 1 of the Enforcement Rule of the Public Health Control Act and install fire safety facilities under the fire safety laws, and check whether an electrical safety inspection or an LPG facility completion inspection is required. The business operator completes 3 hours of hygiene education before filing the report.

  6. 06

Business report and follow-up reports: File the report with the public health division of the competent city, county or district office and receive the business report certificate. If you took over an existing business, report the succession of status within 1 month; if you close, file a closure report within 20 days; while operating, complete hygiene education every year.
