Accommodation registration & reporting

General Lodging Business Report Procedure — Checking Building Use, Educational Environment Protection Zones and Fire Safety

A general lodging business can operate only after a business report is filed with the competent city, county or district (si/gun/gu) office under the Public Health Control Act. Before reporting, first check whether the use in the building register is a lodging facility, whether the site falls within an educational environment protection zone, and whether fire-fighting equipment is installed in each guest room. If the report covers part of a condominium building, documents proving the right to use the business facilities, a liability insurance policy for the common areas and similar documents are submitted together.

Procedure

Procedure type
  • Notification Difficulty Low

You submit the statutory report form and required documents. Once the documents are in order the report is accepted; for some reports the authority checks the contents before accepting it.

We maintain the scope of the existing facility outline form of the general lodging business report, and for residential lodging businesses with cooking facilities with separate requirements for cooking facilities, number of rooms, and usage rights, we prepare and submit reporting documents for the corresponding type. Preliminary applications, deferred management, and change of use of residential lodging facilities with cooking facilities are handled separately.

Scope & fee
General lodging business notification and fill-in facility outline

  1. 1. Determine whether it is a new report or a succession

When taking over an existing lodging establishment, first see whether it can be handled as a succession to the business operator's status. As in a case where an individual takes over a hotel that was run by a corporation, the documents are determined only after you establish whether it is a succession or a new report.

  2. 2. Check the building use and location

Check that the use in the building register is a lodging facility. If the site falls within an educational environment protection zone near a school, deliberation by the office of education may be required, so check before reporting.

  3. 3. Fire and safety inspection

Inspect whether fire-fighting facilities required by fire-related laws are in place, and check whether the business is subject to an electrical safety inspection and a completion inspection of liquefied petroleum gas facilities. A lodging business must take out disaster liability insurance regardless of the floor area of the business premises, so prepare to take it out within 30 days from the date the business report is completed.

  4. 4. Sanitation education and business report

After completing sanitation education for business operators, submit the business report form and the facility documents to the sanitation department of the competent city, county or district (si/gun/gu) office. When the report is received, a business report certificate is issued, and if the facilities need to be checked, an on-site check is carried out within 30 days after issuance.

Required documents

  • Business report form (Enforcement Rule of the Public Health Control Act, Form No. 1)
  • Outline of business facilities and equipment
  • Certificate of completion of sanitation education

  • Certificate of completion inspection of liquefied petroleum gas facilities (if subject to a completion inspection; the official in charge checks it through shared use of administrative information)
  • Electrical safety inspection confirmation certificate (if subject to an electrical safety inspection; the official in charge checks it through shared use of administrative information)

According to the Government24 civil petition guide, there is no fee for a lodging business report. Before receiving the business report certificate, you report and pay the registration license tax (license portion) under the Local Tax Act, and its class is set by the total floor area of the building (Class 1 for 1,500㎡ or more, Class 2 for 1,000㎡ or more but less than 1,500㎡, Class 3 for 500㎡ or more but less than 1,000㎡, and Class 4 otherwise). Our office fee starts from the amount shown above and may vary depending on educational environment protection zone deliberation and whether there is a business succession; we will give you an exact quote after reviewing your documents.

Checked against the statutes on

Statutes and public notices change, so each case needs to be checked individually. Statute titles are given in English for reference. The Korean statutes are the authoritative text.

Check these first

  • Before signing a lease or takeover contract, first check the building use and whether the site falls within an educational environment protection zone.
  • The report may be delayed if fire-fighting equipment is not installed in each guest room.

Frequently asked questions

If I take over a motel, do I need to file a new business report?
There are two ways: succeeding to the existing operator's status, or filing a new report. It depends on the form of the transfer and the status of the existing operator, so check before signing the takeover contract.
What should I check first before a lodging business report?
The first point is whether the use in the building register is a lodging facility. Next, check whether the site falls within an educational environment protection zone and check the fire-fighting equipment in the guest rooms.
Can I run a lodging business near a school?
It is possible in a relative protection zone if the deliberation is passed, but not in an absolute protection zone. A lodging business is prohibited in the absolute protection zone, which extends up to 50m in a straight line from the school gate, and in the remaining relative protection zone within 200m of the school boundary, the regional educational environment protection committee must recognize in its deliberation that the business has no adverse effect on learning and the educational environment. The district office must refuse a lodging business report inside a protection zone without deliberation, so it is safer to check before signing a lease.
What else is needed to run a lodging business in a leased building?
There is no provision that requires the owner's written consent merely because the building is leased. However, when the report covers part of a condominium building, documents proving that you have secured the right to use the business facilities, a liability insurance policy for the common areas and similar documents are submitted together.
