- Appeal Difficulty High
Submitting an opinion, objection or administrative appeal against a disposition or decision already made, or applying for damage relief or dispute mediation. The reviewing body decides after examining the facts and the law, so preparing supporting evidence is important.
We will prepare the long-term care institution's prior notice opinion, business suspension administrative appeal request, and National Health Insurance Service (NHIS) recovery decision review request form. We distinguish between different dispositions and receiving organizations.

Respond during the on-site investigation: Before signing the investigation result confirmation, check for any inaccuracies and record your opinion if there are any. Gather benefit provision records, work schedules and care worker attendance records for the same period as the investigation.
- 02
Classify the issues: Determine whether the case involves claims for services not provided, claims while a care worker was hospitalized or on leave, inflated service hours or staffing standard violations. Also compare by recipient whether it was an error or intentional and whether the amount and period of recovery were calculated correctly.
- 03
Submit opinions on the prior notice: When you receive a prior notice of suspension or a notice of planned recovery, submit an opinion statement and supporting materials within the deadline in the notice. Attach substitute staff records, explanations of record errors and corrective action materials to correct calculation errors first.
- 04
Appeal the suspension and consider a surcharge instead: File an administrative appeal within 90 days of learning of the suspension, and if operations must continue, also apply for a stay of execution. If recipients need protection, also consider requesting that a penalty surcharge replace the suspension.
- 05
Object to the fine for negligence: A fine for negligence is not subject to administrative appeal, so file a written objection with the authority within 60 days of receiving the notice. Once an objection is filed, the imposition loses effect and the case moves to a court fine trial.
- 06
Request review of the recovery decision: For the Service's recovery decision on unjust enrichment, file a request for review with the Service within 90 days of learning of the disposition, and if you disagree, proceed to a request for re-review. These deadlines run separately from the suspension and fine, so manage the dates for each notice.
