Preliminary review and preparation of application documents for legalization and rectification of illegal buildings

The Special Act on the Regularization of Specified Buildings is in force for 18 months from December 17, 2026, and covers residential specified buildings (at least 50% of total floor area in residential use) that were substantially completed as of December 31, 2023, including multi-household houses with an exclusive area of 85 square meters or less per household, detached houses with a total floor area of 165 square meters or less (165 to 330 square meters as set by local ordinance), and multi-family houses with a total floor area of 660 square meters or less. When the owner or builder files a report with the city, county or district office together with design documents and a site survey report prepared by an architect, a use approval is issued within 30 days of the report after review by the building committee if the standards are met. Sites for urban planning facilities, development restriction zones (except buildings built before designation), road buffer zones and conservation mountain areas are excluded, and if enforcement fines or administrative fines are unpaid, use approval is granted only on condition that they are paid in full within 1 year. Buildings outside the Act are resolved by restoration under a corrective order under Article 79 of the Building Act or by an extension or change-of-use permit or report, enforcement fines under Article 80 of the same Act are addressed by submitting opinions at the warning or prior notice stage, and Hwang Yunsang Administrative Office carries out the pre-assessment and prepares and files the report, opinion statements and administrative appeal petitions.

Checking the current status and stage of the measure: Review the illegal-building entry in the building ledger and the corrective order, enforcement fine warning or notice of imposition to confirm the area, use and structure of the violating part and whether the case is at the corrective order, warning or imposition stage.

  2. 02

Eligibility under the Special Act: Check whether the building was substantially completed on December 31, 2023, whether at least 50% of its floor area is residential, whether it falls within the 85 square meter (multi-household), 165 square meter (detached) or 660 square meter (multi-family) limits, and whether it lies in an excluded area such as an urban planning facility site, road buffer zone or conservation mountain area.

  3. 03

Gathering proof of the completion date: Prove completion and residential use before the end of 2023 with aerial photos, enforcement fine records, construction contracts, lease agreements and electricity and water usage records, and confirm land ownership or consent to use the land, or a management body resolution for collective buildings.

  4. 04

Specified building report and review: File the report with the city, county or district office (or its specified building support center, if one exists) within the reporting period set by the Enforcement Decree, attaching design documents and a site survey report prepared by an architect. If the building committee requires improvements to structural safety, evacuation, fire protection or parking, complete them before use approval is granted.

  5. 05

Comparing correction routes when the Act does not apply: Compare restoration with legalizing the building through an extension, major repair or change-of-use permit application or report under the Building Act. Once the correction is completed, new enforcement fines stop immediately, but fines already imposed are still collected.

  6. 06

Opinion statement and administrative appeal: On receiving a prior notice or warning, submit an opinion statement with a correction plan and grounds for reduction by the deadline stated in the notice. If there are grounds to contest the imposition, file an administrative appeal petition with the provincial administrative appeals commission within 90 days of learning of the measure.

A covered building that has never been charged an enforcement fine is subject to an administrative fine equal to 5 times the enforcement fine calculated under Article 80 of the Building Act, and if it was charged fewer than 5 times, the amount already paid is deducted. Incheon Metropolitan City charges half the enforcement fine once a year for residential buildings with a total floor area of 60 square meters or less, among others, but the reduction under Article 80-2 of the Building Act does not apply if the violation is not corrected within 2 years of the first corrective order.
