Preparation of application documents for welfare benefits, facility installation, designation of long-term care institutions, and business closure

An individual or corporation other than the State or a local government that wants to establish and operate a social welfare facility must report the establishment and operation to the competent mayor, county head or district head under Article 34(2) of the Social Welfare Services Act, and facility-specific statutes also apply, such as Article 59 of the Act on Welfare of Persons with Disabilities for disability welfare facilities and the Welfare of Senior Citizens Act for senior welfare facilities. On receiving a report, the city, county or district asks the fire headquarters or fire station to confirm compliance with fire safety laws, and if the standards are met, accepts the report and issues a social welfare facility report certificate. A person whose facility was ordered closed less than 3 years ago, an individual with grounds for disqualification, or a corporation with such an individual as an officer cannot file a report. Social security benefits such as basic livelihood or disability benefits are applied for to the security agency with jurisdiction over the beneficiary's address under Article 5 of the Act on the Use and Provision of Social Security Benefits.

  1. 01

Determine facility type and applicable law: decide whether it is a facility under the Social Welfare Services Act or under a specific statute for persons with disabilities, seniors, children, etc.; capacity, floor area and staffing standards differ between residential and community-use facilities, so check the relevant annex of the enforcement rule first.

  2. 02

Check building use and safety standards: confirm that the use stated in the building ledger meets the facility standards (e.g., facilities for the elderly and children) and that sprinklers and other fire and evacuation equipment can be installed, before signing a lease.

  3. 03

Check the operator and disqualifications: decide whether an individual, a non-profit corporation or a social welfare corporation will operate it, and check whether 3 years have passed since any closure order and whether any officer is disqualified. For a corporation, also check that facility operation is within the purposes in its articles of incorporation.

  4. 04

Prepare the report documents: prepare the report form, the list of property with proof of ownership or right of use, the business plan and budget, a floor plan showing area by floor and structure and a site layout, together with operating rules and a staffing plan.

  5. 05

Filing and on-site check: once filed with the welfare department of the competent city, county or district, a confirmation request to the fire station and an on-site inspection follow. If a supplement is requested, revise the drawings and staffing documents and resubmit.

  6. 06

Report certificate and operating duties: once the report is accepted, receive the social welfare facility report certificate and comply with operating duties such as setting up an operating committee and keeping accounts under the financial and accounting standards. Violations can lead to improvement orders, suspension or closure orders.
