Reapplying for Medical Aid After Suspension — Support Obligor Criteria and 90-Day Objection
The mayor, county head or district head must suspend medical aid when it is no longer needed or the recipient refuses it, and must give the reasons in writing (Medical Aid Act, Article 17). Medical aid under the National Basic Living Security Act covers people who have no support obligor, whose support obligor lacks the ability to support them, or who cannot receive support, and whose recognized income is at or below the selection standard (National Basic Living Security Act, Article 12-3), so once the circumstances behind the suspension change you can apply for benefits again (same Act, Article 21). If you object to the suspension itself, you may file an objection within 90 days from receiving the decision notice (same Act, Article 38).
Procedure
- Application Difficulty Medium
An application for a subsidy, benefit, compensation or decision. The authority reviews whether the payment or selection criteria are met and then decides.
- Appeal Difficulty High
Submitting an opinion, objection or administrative appeal against a disposition or decision already made, or applying for damage relief or dispute mediation. The reviewing body decides after examining the facts and the law, so preparing supporting evidence is important.
We will prepare application documents for basic living, basic pension, pension for the disabled, and single parent benefits, as well as documents for reporting the establishment of a social welfare center. The closure or abolition of a long-term care institution and the designation of a new transferee are separate procedures.

1. Check the reasons in the suspension notice
When medical aid is suspended, the mayor, county head or district head must notify the reasons in writing (Medical Aid Act, Article 17, Paragraph 3), and a suspension of benefits under the National Basic Living Security Act is also notified in writing with specific reasons including the calculation basis (National Basic Living Security Act, Article 30, Paragraph 3 and Article 29, Paragraph 2). Check in the notice whether the suspension was based on the support obligor's income or property, your household's recognized income, or a refusal of investigation. Benefits may also be suspended where a verification investigation or a request for documents was refused 2 or more times (same Act, Article 23, Paragraph 3).
2. Review the support obligor criteria again
A support obligor is a lineal blood relative of the first degree of the beneficiary and that relative's spouse, excluding the spouse of a deceased first-degree lineal blood relative (same Act, Article 2, Item 5). Support is deemed unavailable where the support obligor is serving in the military, has emigrated, is held in a correctional or similar facility, is subject to pending disappearance proceedings, has been reported as having run away or gone missing for more than 1 month, or avoids or refuses support (same Act, Article 8-2, Paragraph 2). Compare with the time of suspension and confirm with evidence how the support obligor's income, property or family relationship has changed.
3. Submit the benefit application
Not only the beneficiary but also relatives or other interested persons may apply for benefits to the mayor, county head or district head having jurisdiction over the place of residence (same Act, Article 21, Paragraph 1; Enforcement Rule of the same Act, Article 34, Paragraph 1). When applying, the beneficiary and the support obligors must submit consent forms for the provision of financial, credit and insurance information (same Act, Article 21, Paragraph 3). Social welfare officials must explain the selection standards and application methods in an easy-to-understand way and must not induce the applicant to withdraw or give up the application (same Act, Article 21, Paragraphs 4 and 5).
4. Investigation and decision notice
The mayor, county head or district head investigates whether there is a support obligor and their ability to support, and the income and property of the beneficiary and the support obligors (same Act, Article 22, Paragraph 1). The decision must be notified within 30 days from the application date, and where there are special reasons such as a lengthy investigation of the support obligor, it may be notified within 60 days (same Act, Article 26, Paragraph 4). Once benefits are granted, they start from the application date (same Act, Article 27, Paragraph 1).
5. Objection to the suspension
If you object to a disposition by the mayor, county head or district head, you may file an objection in writing or orally with the mayor or provincial governor through the relevant security agency within 90 days from receiving the decision notice, and the governor reviews it within 30 days (same Act, Articles 38 and 39). The Medical Aid Act also allows a written objection to the mayor, county head or district head within 90 days from the date you became aware of a disposition concerning eligibility as a medical aid beneficiary (Medical Aid Act, Article 30). Check the appeal procedure and deadline stated in the notice as well.

Check these first
- If the beneficiary or a support obligor refuses, obstructs or evades an investigation or a request for documents 2 or more times, the benefit application may be dismissed (National Basic Living Security Act, Article 22, Paragraph 8), so respond to the security agency's requests within the deadline.
- Even after becoming a beneficiary again, you must report without delay to the competent security agency if your area of residence, household composition, lease terms or matters concerning the support obligor change significantly (National Basic Living Security Act, Article 37).
